3 WHEREAS, the City of Saint Paul, under its delegation agreement with
4 the Minnesota Department of Health, has the authority to license and
5 inspect the food service in child care centers; and
6
7 WHEREAS, the City of Saint Paul seeks not only to protect the public
8 l�ealth of children, but to foster the ability of child care centers to meet
9 the demand for service with a minimum of regulation and financial
10 hardship; and
11
12 WHEREAS, the Saint Paul City Council is concerned about nutritional
13 needs of children; and
14
15` WHEREAS, there is concern about the level and type of regulation
16 necessary to impose on child care centers with limited food service.

18 THEREFORE, BE IT RESOLVED that the Saint Paul City Council,
19 acting as the Board of Health, directs the Director of the Public Health
20 Division to maintain its enforcement policy for inspection of food service
21 in child care centers with full meal preparation; and
22
23 BE IT FURTHER RESOLVED that the Saint Paul City Council, acting as
24 the Board of Health, respectfully requests that the Minnesota
25 Commissioner of Health convene a task force to explore and develop rules
26 and regulations regulating those child care centers conducting limited food
27 service; and
28
29 BE IT FURTHER RESOLVED that the Council of the City of Saint Paul,
30 acting as the Board of Health, respectfully suggests that the task force be
31 comprised of regulatory officials from both state and local government,
32 child care providers, parents of children using child care services,
33 nutritionists, and other interested citizens as the Commissioner deems
34 appropriate; and

6 BE IT FURTHER RESOLVED that the Division of Public Health will
7 maintain the current enforcement policy until the task force develops
8 guidelines or until this resolution is rescinded by action of the Board of
9 Health.

Concern in the Chi1d Care community concerning regulations proposed by the City
Public Health Division that would impose restrictions on food service in child care center
has led to strong feeling that the regulations must be clarified and may be overly
burdensome to many smaller day care centers.
ADVMITIUiEB IF APPROVED:
Current enforcement levels and inspections of day care food service �e�lould be maintained,
so that children's health would not be put at risk, and the regulations would be
clarified and evaluated to ensure that children's safety and nutritional needs are met
and enforced without unduly burdening day care providers.

Increased enforcement of food service regulations in small day care centers will be
delayed. Child care centers will continue to serve "cooked foods" such as popcorn,
reconstituted �uice, and canned fruit. �
