Presented By /C�� ✓ , Referred To Committee: Date RESOLVED , that upon the petition of Tilsner Carton Company, per Finance Department File No. 2-1990, the alley in Block 5, Edmund Rice ' s 3rd Addition to St. Paul , bounded by Cayuga Street , Agate Street, and York Avenue, hereinatter described, be and the same is hereby vacated and discontinued as public property. The vacated area is described as follows: The East-West alley in Block 5, Edmund Rice ' s 3rd Addition to St. Paul This vacation shall be subject to the following conditions: . 1. That this vacation shall be subject to all the terms and conditions of Chapter 130, codified March l , 1981, of Saint Paul Legislative Code, as amended . 2. That the petitioner , its successors , and assigns shall pay the city $5, 745. 0P1 as compensation for the vacation which is due and payable within 60 days of the publication date of this resolution. 3 . That a permanent utility easement be retained within the vacated area to protect the interests of Northern States Power Company. 4 . That a permanent utility easement be retained within the vacated area to protect the interest of Continental Cablevision. 5. That a permanent utility easement be retained within the vacated area to protect the interests of U. S. West. 6 .
