RESOLVED , that upon the petition of Tilsner Carton Company,
per Finance Department File No. 2-1990, the alley in Block 5,
Edmund Rice ' s 3rd Addition to St. Paul , bounded by Cayuga Street ,
Agate Street, and York Avenue, hereinatter described, be and the
same is hereby vacated and discontinued as public property.
The vacated area is described as follows:
The East-West alley in Block 5, Edmund Rice ' s 3rd
Addition to St. Paul
This vacation shall be subject to the following conditions:
. 1. That this vacation shall be subject to all the
terms and conditions of Chapter 130, codified
March l , 1981, of Saint Paul Legislative Code, as
amended .
2. That the petitioner , its successors , and assigns
shall pay the city $5, 745. 0P1 as compensation
for the vacation which is due and payable
within 60 days of the publication date of
this resolution.
3 . That a permanent utility easement be retained
within the vacated area to protect the
interests of Northern States
Power Company.
4 . That a permanent utility easement be retained
within the vacated area to protect the
interest of Continental Cablevision.
5. That a permanent utility easement be retained
within the vacated area to protect the
interests of U. S. West.
6 . That the petitioner , its heirs , and assigns , by
, acceptance of the terms and conditions of this
vacation, agree to indemnify, defend , and
save harmless the City of Saint Paul , its
officers , and employees from all suits ,
actions, or claims of any character brought as a
result of injuries or damages received or
sustained by any person, persons, � or
property on account of this vacation, or

but not limited to a claim brought because of
any act of omission, neglect or misconduct of said
petitioner or because of any claims or liability

within 6� days of the publication date of this
resolution, file with the city clerk, an
acceptance in writing of the conditions of
' this resolution and shall within the period (s)
specified in the terms and conditions of
this resolution, comply in all respects with
these terms and conditions.

Saint Paul when their property is not kept up ,
ADVMITAOES IF APPROVED:
Cost recovery program to recover expenses incurred by City of Saint Paul. for cleaning up _
the property. This includes cutting tall grass and weeds, hauling away all garbage, debris,
refuse and tires. All household items such as refrigerators, stoves, sofa chairs and all
other items. Also for removing snow and ice or sanding for icy sidewalks. . .. �
