RESOLVED, That upon execution and delivery of a release in full to
the City, in a form to be approved by the City Attorney, the proper
City officers are hereby authorized and directed to pay out of the
Tort Liability Fund, 09070-0511, to: Bruce Marston and American
Family Insurance Group the sum of $2,559.92 in full settlement of
their claim of damages sustained on or about December 27, 1989, as
.more particularly set out in the Notice of .Claim filed in the City
Clerk's office on February 26, 1990.

criminal division prosecutes with St. Paul police officers as witnesses. When those same
officers engage in criminal activity, it becomes a professional conflict of interest to
review and prosecute those officers. Additionally, the victim is an attorney in the
St. Paul City Attorney's office.
