Ar�jordinance amending section 125.02 (a) of the Saint Paul Leg�slative Code.,pertaining to Permits for Street Obstructions. - The Council ofs#he City of Saint Paul Does Ordain: ;� Section 1 , That section 125.0�.(a) of the Saint Paul Legxslative Code is hereby amended to read as follovvs� �,, � , .` (a) Any permittee grante�� permit p�rrsuant to this chapter shall pay to the director of public works at t time: of application a permit fee as set forth below. Such fee shall not be e�ried to limit in any way the right of the city to reimbursement from the perrtx ee for the actual expense incurred by the city in restoring any such pubkc praperty and improvements to their original condition. The types of perr�xfts and f8�s shall be as follows: � (1) Permit; Fixed Location; Fee; Per'i�d. Except as provided in clause (2); a separate permits shall be . required for each location in the city where.the street obstruction is to , occur. The permit fee shall be an applicatiqn fee, plus an additional amount to be computed according to the portian of public right-of-way being occt�pied, the length of area in fifty foot increments and the duration of the permit. The director of public works shall establish a table of fees, which table shall be subject to the app�oval by resolution of the: city council and a copy shall be maintained in the office of city clerl�. The table of fees shall�be amended annually, and may be am�nded at other times as deemed necessary by the direc�or. The maximum period allowed for a permit shall be thre� months. Use of the public property beyond the period covered by each permit will require the obtaining a new permit, payment of applicable fees, and shall be subject to the same review as the original permit application. The amount of public property to be used shail be determined by the /� director of public works. , , �y'a-��z . OR # GINAL � _2_ t, � (2) Various Locations; Fee. � �`� A various locations permit may be issued only to .COmpanies performing maintenance work of short duration and minimum ` .complexity, subject to the approval of the director of.public works and the police department, traffic and accident section, 7he permit shall be issu�sd for a period of one year. A various loca�i6n permit may be used at only one location at any one time, and m�fst be openly displayed at all times while maintenance work is being'performed. The annual fee for each various location permit is $104:40. A various locations permit is��o be used only in the normal course of the permittee's nor�al work day, and shall not be valid in rush hour zones during posted rush hours. The amount of public right-of-way to be used shall not exceed��(? lineal feet of street frontage. The width of said frontage may include the sidewalk and/or boulevard and/or 10 feet of traveled street as.measured fro�n the curb line or edge of the traveled street and shall be subject to approval by the director of public works. Emergency use'of a various locations permit during hours not covered by this sec�irsn shall be subject to approval by the traffic and accident section vf the police department. The permit shall be subject to revoca#ion without refund of fees upon evid�nce of non-compliance with any of the provisions of this chapter.
