RESO VED, that upon the petition of Health One Corporation,
per Finan e Department File No. 1-19941, the alley in Block 50 ,
Dayton an Irvine' s Addition to St. Paul, bounded by Sherman
Street an Grand Avenue, hereinafter described , be and the same
is hereby vacated and discontinued as public property.
The � acated area is described as follows:

The acation shall be subject to the following conditions :
1) That this vacation shall be subject to the
terms and conditions of Chapter 13P1, codified
March 1 , 1981, of the Saint Paul Legislative
Code, as amended .
2) That the petitioner , its successors , and
assigns shall pay the city $4,538 . 00 as
compensation for the vacation which is due
� and pa.yable within 60 days of the publication
I date of this resolution.
3) That the petitioner, its successors, and assigns
� shall dedicate an easement for right-of-way
' purposes, to the city, in a form and manner to be
� approved by the City Attorney, the following
; described land:
� All that part of Lots 13 and 14 ,
Thomas Daly' s Subdivision of Lots 4, 5,
6, and 7 , Block 50, Dayton and Irvine' s
Addition to St. Paul, according to the
i plat thereof of record in Ramsey County,
Minnesota, which is more particularly
i described as follows:

Beginning at the most westerly corner of
said Lot 14 , being the intersection of
- the � northerly line of Grand Avenue and
the southeasterly line of Smith St•reet;
thence along the southerly line of said
, Lots 14 and 13 , South 89 degrees 55
� minutes 28 seconds East, assumed basis
of bearings, a distance of , 66 . 01 feet to

4) That the petitioner , its successors, and assigns
by acceptance of the terms and conditions
of this vacation, agree to indemnify, defend, and
save harmless the City of Saint Paul, its officers,
and employees from all suits , actions, or claims
of any character brought as a result of injuries
or damages received or sustained by any person,
persons, or property on account of this
vacation , or petitioner ' s use of this property,
including but not limited to a claim brought
because of any act of omission, neglect or
misconduct of said petitioner or because of
any claims or liability arising from any
violation of any law or regulation made in
accordance with the law whether by the petitioner
of any of its agents or employees.
5) That the petitioner , its successors, and assigns ,
shall within 60 days of the publication date
of this resolution, file with the city clerk,
an acceptance in writing of the conditions
of this resolution and shall within the period
(s) specified in the terms and conditions of
this resol
