Gerry Strathman statcd he is not troubled by thc fcnce being 42 inches instead of 48 inches
because 42 inches should keep a child out. If someone is that determined to climb over it, they
can just as easily climb over a 42 inch fence as well as a 48 inch fence. About the visibility of
the pool, Mr. Strathman stated he has seen situations where people have an opaque plastic
aftached to their chain link fence to prevent peopie from seeing through it and viewing the pool.
Mr. 3tzathman explained the location where he has seen this. Warren Ketola responded he had
not seen this type of installation, but small people can still see over a 42 inch fence as evident in
the photographs he had shown eazlier. Mr. Ketola stated the photographs were taken from ihe
eye level of a toddler.
Gerry Strathman granted a variance with respect to the fence on the condition that the ladder and
any other device used to get into the pool will be locked up when the poo] is not being used.

Robert McClay and Wendy I.ee appeared. Mr. McClay stated petitions were filed concerning
deficiency/correction lists issued by Fire Prevention. In some instances, the items do not warrant
citations by the City. Some items are cosmetic matters that do not rise to the level of health and
safety which is the purpose of the housing code. Gerry Strathman responded the housing code
also deals with appearance. Mr. McClay stated Wendy Lee is here to testify on the Case
addresses. The person who is best able to testify on behalf of the Sims addresses is at the site
right now with personnel from Fire Prevention. Pat Fish concurred that staff was llaere.
Gerry 5trathman stated he has documents received on July 30 that have handwritten notes on
most of the items and asked what they are. Pat Fish responded the handwritten notes aze from
the inspector Barb Cummings. It is Fire Prevention's contention that items cited more than ten
days ago from previous inspections were not appealable. Mr. Strathman stated he will hear
everythang that needs to be said. Robert McCiay stated he did not have a copy of this July 301ist.
Mr. Strathman had copies made and gave Robert McClay and Wendy I,ee time to review the
document.
(This matter was discussed later in the meeting.)
905 Westminster Street
William Wilcox, owner, appeared. The garden level apartment windows are too high. They are
50 1/2 inches and are suppose to be 48 inches. A step could be built, but Mr. Wilcox does not
think that is going to last. Mr. Wilcox asked why the City changed the ordinance. Pat Fish
responded the ordinance did not change. The numbers aze so close that the inspectors might have
thought it was 48 inches. Mr. W ilcox stated every window has a baseboazd register underneath
it.
Gerry Strathman granted a variance with respect to the windows.

Each item on the deficiency/correction lists for the Case Avenue buildings were reviewed.
Wendy L.ee explained which items were done and which were not done.
Robert McClay suggested ]aying over the addresses on the Sims buildings because the two
people that know the most about it, as mentioned earlier, aze on site inspecting the addresses.
Gerry Strathman responded he was very concerned about any furttter delay because there seems
to be a pattern of neglect. Some items are reoccurring, however some items were cited June 4
and had not been done by July 14. The goal is to bring the building under compliance with the
code. .
Mr. McClay stated it seems it would be useful to identify the items not done and deternune
whether they are health and safety items or cosmetic items. Mr. Strathman responded his role is
to review the actions of the Fire Department. By filing the appeal, the owner has said those
actions are improper. However, the actions of the Fire Department are sufficient to make a
revocation of the certificate of occupancy a reasonable action.
Mr. McClay stated due process would warrant that Mr. Strathman finish hearing the case and
understand what the specific deficiencies are and weigh those in the context of the decision Mr.
Strathman is charged to make. Mr. Strathmaa stated that is what he is doing, but his role is not to
evaluate each decision the fire department made on each specific violation. His role is to see
whether there is reasonable cause to believe the Fare Department has acted contrary to the facts or
contrazy to the city ordinances. If the property owner is not properly notified, that would be a
deficiency. If the allegations the Fire Department used are all false and if the situations did not
exist, that would be a basis. However, no one is contending these things are not true. The owner
was notified, the items are true, and the opgortunity to correct was given. Mr. McClay stated
there was more testimony he wanted to give, and he had not rested his case. He requested that
Mr. Strathman consider whether these items are germane to a matter as serious as a certificate of
occupancy revocation.
Each item on the deficiency/correction lists for the Case Avenue buildings was reviewed again.
Gerry Strathman asked why people are being evicted in August and not eazlier than this. Wendy
I.ee responded because a lot of the residents aze on the 5ection 8 program. A lot of leases are
coming up for renewal. Ms. Lee just took over the Case addresses in April. Mr. Strathman
asked is she suggesting the buildings will be straightened up now that she is managing the
building. Ms. L,ee responded yes. She has attended the multi housing program with the Saint
Paul Police Depaztment Force Unit, the buildings are getting security, she is meeting with the
owner to get cazetakers instead of a cleaning company, and is screening people in a different way
than the former property manager.

Robert McClay stated there was a criminal matter that was settled in Mazch; he explained the
matter in detail.
Pat Fish stated the key to the problem is on site people. There needs to be some presence on the
property. Wendy I,ee reiterated that she is talking to the owner about this.
Gerry Strathman laid over this matter to the September 1 Property Code Enforcement meeting.

In 1990, the City/HRA work with Twin Cities Housing Development Corporation in putting
together the St. Paui Affordable Housing Development. This development included three major
housing complexes: Westmister Gardens (1319-1375 Westminster, 108 units; Flandrau Court
(1741-1501 Sims, 18 units; and Birmingham Woods (1426-1436 Case, 24 units).
7he financing package was as follows:
$3,160,000 ist mortgage loan bond (Fannie Mae)
637,000 Mpls./St. Paul Family Housing Fund
185,000 MHFA (Minnesota Housing Finance Agency)
547,000 HRA/Ciry
Properties went into foreclosure in .October, 1993. Indications were that the property at
Westminster caused the default of the overall financing package. Properties were packaged as
a fire sale after the toreclosure. HRA/City approved write off of loan in August, 1995.
Based on the funds put in by HRA of $547,000 spread over 150 unints, the gap per unit is
$3,646.66. However, in talking with Gary Peltier, a majority of the rehab was done on Flandrau
� Court to convert 36 units down to 18 units for large families.
Any questions on this background information, please let me know.

As a member of the Saint Paul City Council, I am well aware of the need to provide decent and
affordable housing for the many hardworking families who ]ive in the city. I believe that one of the
goals of our community should be to preserve affordable rental housing tha[ is already in existence
to a quality and standard that enhances the lives of lts residents and the neighborhood. That the
preservation of affordable housing units need to be considered in the context of its surraundings and
the need for the units to be preserved. L.arge family units aze in great demand and no new
construction of three plus bedroom units are being built.
• The Birmingham Woods development represents the vuiety of rental housing that we need to
preserve and enhance. The development houses twenty-four working families in units that are large
enough for their families' needs. It is essential to provide safe and sanitary housing for families who
are not yet ready to move into homeownership opportunities with their families. However, in
addition to preserving these needed lazge housing units, it is essential that support services and on-
site management aze a strong component in the development. That resident participation in the
maintenance and quality of life issues must be strongly enforced in order to provide good
neighborhood housing and stabiliry to the azea. Management and residents must play an active rale
in this enforcement either in the concept of cooperative ownership housing and/or strong leases that
allow for immediate action.
I strongly endorse North East Neighborhoods Development Corporation and Real Estate Equities'
efforts to stabilize this property and retain this much needed family housing in the Greater East Side
neighborhood.

Directors pessed the following resolution:
That District 2 wges the City of St. Paul to enforce City codes to the maximum extent
pos�ible and to give the owners no fiuther extensions for fixing code violatioas at Flandrau
Court and Birmingham Woods Apartments.
These buildings have been problems for our neighborhood £or many yeazs. These poorly
maintained apartment buildings have long had a detrimental impact on the surrounding
• neighborhoods. Nearby residents work hard to keep their homes looking nice. They complain that
the lack of upkeep at these buildings makes their e�orts futile: They ere generally proud of their
East Side neighborhood, but are embarrassed to take visitors around these apaRments. Neighbors
are tired of the tcash from these buildings blowing through the neighborhood. They are also tised of
having to call the city and register comptaints just to get basic maintenance done. Some former
residents have cited these apartments as a major reason for sel]ing their long-time homes and
moving to the subuzbs.
These buildings havc been a problem for too long. Hazel Park ces"sdents are extremeSy frustrated and
angry about the lack of progess on these apartment buildings. Please support the residents of
Haze1 Park by holding these landlords responsible for the condition of their buildings.

This letter is concerning the �'landrau Court and Bimvngham Woods apartment units. I
would strongly urge the council to hold these units to the highest possible standards of
enforcement.
I live near the Flandrau Court apartments. My spouse and I moved in from the suburbs a
little over four years ago. We were attracted by the wonderful oid houses in the Fiazel
park area. We have gitven a few interviews to the tocal papers regarding our move. We
really love our house, but the stress and fear caused by these poorty managed and
maintained units are causing us to consider moving.
We have seen constant drug deali�sg on the screet &om these buildings. We have our
sleep distwbed constantiy by fights in the parking lot, cars and taxis honking theit homs,
and yelling and xreaming by tenants and gvests. On more than on occasion we have
awoken to gunshots in the middle of the night and in one instance wimessed the aRezmath
of a shooting.
• Pear of harassmeat and fear for personal safety cause us to avoid these areas. This is no
way to live. I have devoted many hours of my personal time to help this community, but 1
sometimes feel my efforts are wasted while these units are allowed to continually do quick
fixes, then quickly degrade back to the usual poor condition. I and others aze putting off
improvements to our homes beoause of this. We are worried about throwing good money
after bad.
The destructive force poorly managed and maicrtained units do to the neighborhood
cannot be overestimated. They are destroying this area. I do oot want to move but I fee)
my hand 'zs being forced "�'his could be a beautiful neighborhood if not fo� this in our
midst. pnce again, I urge you not to let these people slip out of their responsibilities and
hope you hold them to the highest possible standards.

I'm looking for help. I am very frustrated and don't know where to go for
help. I live on Sims Ave, 1 block west of White Bear Ave and we have
some serious problems with the residents in the Apartment complex on
our block. This problem has been around for the last few years but it
has beinq increasingly worse and worse.
The entire block on Sims Ave between White Bear.Ave and Flandrau is
£ilthy. There is trash all over the place, a 1ot of it blowing into my yard &
left for me to clean up.
There is glass on the PUBLIC sidewalks to when ahildren are walking to
the elementry school (Case & White Bear) they have to walk through the
glass or in the streets.
Children living in these apartments are not watched by their parents, and
even some that are being watched by adults are destroying property of

We have just this week had our basketball hoop ripped out and left in our
driveway by these children. Our neighbors have had children climb on
their garage roof & tear shingles off the roof. From the time we come
home from work until sometime between 10pm and midnight (sometimes
later) we hear constant yelling, screaming, fighting and worse of all
EXTREAMLY VLTLGAR language.
When trying to drive down the street to leave and to come home we
usually have children playing in the middle of the street and refuse to
move for traffic.
The residents of these apartments ignore the stop sign at the corner of
Sims & Flandrau and many times speed by VERY fast. Car radios are so
loud at times that my entire house shakes from the vibration.
A week ago we had a resident from these apartments that was
intoxicated, blocking traffic and threating everyone within site. He
urinated in £ront of our home, we had called the police & it took over 45
minutes for them to come.

as frustrated as myself. She shared with me that they are afraid in there
own home and have a real difficult time trying to do anything about it
because they have difficulty with a language barrier (they are Hmong).
She says her children can only play in a small fenced part of there yard
because i£ they are not in that part then the people living in the
apartments are threating & scaring them.
We-live here too, we pay property taxes and we should NOT have to
keep our children locked up in our homes. We have tried calling police on
distrubance calls, however, the last time we did they never showed up.
I know they are busy and especially on Friday and Saturday nights,
whiah is when it gets REALLY bad around here. I know also that they
can only provide a temporary fix for these problems.
As a homeowner myself, I know that I am responsible for keeping my
yard & sidewalks clean. If I have trash all over my yard the city could
demand that I clean it or have it done for me & charge me. Also as a
homeowner and a parent it is my responsibilty to keep my children from
demand that I clean it or have it done for me & charge me. Also as a

causing damage to other property in the neighborhood. Are these
apartment owner(s) above being responsible £or their property and the
people they rent to?
I work 45+ hours a week, go to school 2 nights a week & have 2 children
to raise. I don't have a lot of spare time to cre�te a neighborhood
crimestoppers chapter or to call every city official to solve this problem
myself, I need your help!

Gerry Strathman statcd he is not troubled by thc fcnce being 42 inches instead of 48 inches
because 42 inches should keep a child out. If someone is that determined to climb over it, they
can just as easily climb over a 42 inch fence as well as a 48 inch fence. About the visibility of
the pool, Mr. Strathman stated he has seen situations where people have an opaque plastic
aftached to their chain link fence to prevent peopie from seeing through it and viewing the pool.
Mr. 3tzathman explained the location where he has seen this. Warren Ketola responded he had
not seen this type of installation, but small people can still see over a 42 inch fence as evident in
the photographs he had shown eazlier. Mr. Ketola stated the photographs were taken from ihe
eye level of a toddler.
Gerry Strathman granted a variance with respect to the fence on the condition that the ladder and
any other device used to get into the pool will be locked up when the poo] is not being used.

Robert McClay and Wendy I.ee appeared. Mr. McClay stated petitions were filed concerning
deficiency/correction lists issued by Fire Prevention. In some instances, the items do not warrant
citations by the City. Some items are cosmetic matters that do not rise to the level of health and
safety which is the purpose of the housing code. Gerry Strathman responded the housing code
also deals with appearance. Mr. McClay stated Wendy Lee is here to testify on the Case
addresses. The person who is best able to testify on behalf of the Sims addresses is at the site
right now with personnel from Fire Prevention. Pat Fish concurred that staff was llaere.
Gerry 5trathman stated he has documents received on July 30 that have handwritten notes on
most of the items and asked what they are. Pat Fish responded the handwritten notes aze from
the inspector Barb Cummings. It is Fire Prevention's contention that items cited more than ten
days ago from previous inspections were not appealable. Mr. Strathman stated he will hear
everythang that needs to be said. Robert McCiay stated he did not have a copy of this July 301ist.
Mr. Strathman had copies made and gave Robert McClay and Wendy I,ee time to review the
document.
(This matter was discussed later in the meeting.)
905 Westminster Street
William Wilcox, owner, appeared. The garden level apartment windows are too high. They are
50 1/2 inches and are suppose to be 48 inches. A step could be built, but Mr. Wilcox does not
think that is going to last. Mr. Wilcox asked why the City changed the ordinance. Pat Fish
responded the ordinance did not change. The numbers aze so close that the inspectors might have
thought it was 48 inches. Mr. W ilcox stated every window has a baseboazd register underneath
it.
Gerry Strathman granted a variance with respect to the windows.

Each item on the deficiency/correction lists for the Case Avenue buildings were reviewed.
Wendy L.ee explained which items were done and which were not done.
Robert McClay suggested ]aying over the addresses on the Sims buildings because the two
people that know the most about it, as mentioned earlier, aze on site inspecting the addresses.
Gerry Strathman responded he was very concerned about any furttter delay because there seems
to be a pattern of neglect. Some items are reoccurring, however some items were cited June 4
and had not been done by July 14. The goal is to bring the building under compliance with the
code. .
Mr. McClay stated it seems it would be useful to identify the items not done and deternune
whether they are health and safety items or cosmetic items. Mr. Strathman responded his role is
to review the actions of the Fire Department. By filing the appeal, the owner has said those
actions are improper. However, the actions of the Fire Department are sufficient to make a
revocation of the certificate of occupancy a reasonable action.
Mr. McClay stated due process would warrant that Mr. Strathman finish hearing the case and
understand what the specific deficiencies are and weigh those in the context of the decision Mr.
Strathman is charged to make. Mr. Strathmaa stated that is what he is doing, but his role is not to
evaluate each decision the fire department made on each specific violation. His role is to see
whether there is reasonable cause to believe the Fare Department has acted contrary to the facts or
contrazy to the city ordinances. If the property owner is not properly notified, that would be a
deficiency. If the allegations the Fire Department used are all false and if the situations did not
exist, that would be a basis. However, no one is contending these things are not true. The owner
was notified, the items are true, and the opgortunity to correct was given. Mr. McClay stated
there was more testimony he wanted to give, and he had not rested his case. He requested that
Mr. Strathman consider whether these items are germane to a matter as serious as a certificate of
occupancy revocation.
Each item on the deficiency/correction lists for the Case Avenue buildings was reviewed again.
Gerry Strathman asked why people are being evicted in August and not eazlier than this. Wendy
I.ee responded because a lot of the residents aze on the 5ection 8 program. A lot of leases are
coming up for renewal. Ms. Lee just took over the Case addresses in April. Mr. Strathman
asked is she suggesting the buildings will be straightened up now that she is managing the
building. Ms. L,ee responded yes. She has attended the multi housing program with the Saint
Paul Police Depaztment Force Unit, the buildings are getting security, she is meeting with the
owner to get cazetakers instead of a cleaning company, and is screening people in a different way
than the former property manager.

Robert McClay stated there was a criminal matter that was settled in Mazch; he explained the
matter in detail.
Pat Fish stated the key to the problem is on site people. There needs to be some presence on the
property. Wendy I,ee reiterated that she is talking to the owner about this.
Gerry Strathman laid over this matter to the September 1 Property Code Enforcement meeting.

In 1990, the City/HRA work with Twin Cities Housing Development Corporation in putting
together the St. Paui Affordable Housing Development. This development included three major
housing complexes: Westmister Gardens (1319-1375 Westminster, 108 units; Flandrau Court
(1741-1501 Sims, 18 units; and Birmingham Woods (1426-1436 Case, 24 units).
7he financing package was as follows:
$3,160,000 ist mortgage loan bond (Fannie Mae)
637,000 Mpls./St. Paul Family Housing Fund
185,000 MHFA (Minnesota Housing Finance Agency)
547,000 HRA/Ciry
Properties went into foreclosure in .October, 1993. Indications were that the property at
Westminster caused the default of the overall financing package. Properties were packaged as
a fire sale after the toreclosure. HRA/City approved write off of loan in August, 1995.
Based on the funds put in by HRA of $547,000 spread over 150 unints, the gap per unit is
$3,646.66. However, in talking with Gary Peltier, a majority of the rehab was done on Flandrau
� Court to convert 36 units down to 18 units for large families.

As a member of the Saint Paul City Council, I am well aware of the need to provide decent and
affordable housing for the many hardworking families who ]ive in the city. I believe that one of the
goals of our community should be to preserve affordable rental housing tha[ is already in existence
to a quality and standard that enhances the lives of lts residents and the neighborhood. That the
preservation of affordable housing units need to be considered in the context of its surraundings and
the need for the units to be preserved. L.arge family units aze in great demand and no new
construction of three plus bedroom units are being built.
• The Birmingham Woods development represents the vuiety of rental housing that we need to
preserve and enhance. The development houses twenty-four working families in units that are large
enough for their families' needs. It is essential to provide safe and sanitary housing for families who
are not yet ready to move into homeownership opportunities with their families. However, in
addition to preserving these needed lazge housing units, it is essential that support services and on-
site management aze a strong component in the development. That resident participation in the
maintenance and quality of life issues must be strongly enforced in order to provide good
neighborhood housing and stabiliry to the azea. Management and residents must play an active rale
in this enforcement either in the concept of cooperative ownership housing and/or strong leases that
allow for immediate action.
I strongly endorse North East Neighborhoods Development Corporation and Real Estate Equities'
efforts to stabilize this property and retain this much needed family housing in the Greater East Side
neighborhood.

Court and Birmingham Woods Apartments.
These buildings have been problems for our neighborhood £or many yeazs. These poorly
maintained apartment buildings have long had a detrimental impact on the surrounding
• neighborhoods. Nearby residents work hard to keep their homes looking nice. They complain that
the lack of upkeep at these buildings makes their e�orts futile: They ere generally proud of their
East Side neighborhood, but are embarrassed to take visitors around these apaRments. Neighbors
are tired of the tcash from these buildings blowing through the neighborhood. They are also tised of
having to call the city and register comptaints just to get basic maintenance done. Some former
residents have cited these apartments as a major reason for sel]ing their long-time homes and
moving to the subuzbs.
These buildings havc been a problem for too long. Hazel Park ces"sdents are extremeSy frustrated and
angry about the lack of progess on these apartment buildings. Please support the residents of
Haze1 Park by holding these landlords responsible for the condition of their buildings.

This letter is concerning the �'landrau Court and Bimvngham Woods apartment units. I
would strongly urge the council to hold these units to the highest possible standards of
enforcement.
I live near the Flandrau Court apartments. My spouse and I moved in from the suburbs a
little over four years ago. We were attracted by the wonderful oid houses in the Fiazel
park area. We have gitven a few interviews to the tocal papers regarding our move. We
really love our house, but the stress and fear caused by these poorty managed and
maintained units are causing us to consider moving.
We have seen constant drug deali�sg on the screet &om these buildings. We have our
sleep distwbed constantiy by fights in the parking lot, cars and taxis honking theit homs,
and yelling and xreaming by tenants and gvests. On more than on occasion we have
awoken to gunshots in the middle of the night and in one instance wimessed the aRezmath
of a shooting.
• Pear of harassmeat and fear for personal safety cause us to avoid these areas. This is no
way to live. I have devoted many hours of my personal time to help this community, but 1
sometimes feel my efforts are wasted while these units are allowed to continually do quick
fixes, then quickly degrade back to the usual poor condition. I and others aze putting off
improvements to our homes beoause of this. We are worried about throwing good money
after bad.
The destructive force poorly managed and maicrtained units do to the neighborhood
cannot be overestimated. They are destroying this area. I do oot want to move but I fee)
my hand 'zs being forced "�'his could be a beautiful neighborhood if not fo� this in our
midst. pnce again, I urge you not to let these people slip out of their responsibilities and
hope you hold them to the highest possible standards.

I'm looking for help. I am very frustrated and don't know where to go for
help. I live on Sims Ave, 1 block west of White Bear Ave and we have
some serious problems with the residents in the Apartment complex on
our block. This problem has been around for the last few years but it
has beinq increasingly worse and worse.
The entire block on Sims Ave between White Bear.Ave and Flandrau is
£ilthy. There is trash all over the place, a 1ot of it blowing into my yard &
left for me to clean up.
There is glass on the PUBLIC sidewalks to when ahildren are walking to
the elementry school (Case & White Bear) they have to walk through the
glass or in the streets.
Children living in these apartments are not watched by their parents, and
even some that are being watched by adults are destroying property of

We have just this week had our basketball hoop ripped out and left in our
driveway by these children. Our neighbors have had children climb on
their garage roof & tear shingles off the roof. From the time we come
home from work until sometime between 10pm and midnight (sometimes
later) we hear constant yelling, screaming, fighting and worse of all
EXTREAMLY VLTLGAR language.
When trying to drive down the street to leave and to come home we
usually have children playing in the middle of the street and refuse to
move for traffic.
The residents of these apartments ignore the stop sign at the corner of
Sims & Flandrau and many times speed by VERY fast. Car radios are so
loud at times that my entire house shakes from the vibration.
A week ago we had a resident from these apartments that was
intoxicated, blocking traffic and threating everyone within site. He
urinated in £ront of our home, we had called the police & it took over 45
minutes for them to come.

I talked to another private homeowner on our street. They also are just ��'
as frustrated as myself. She shared with me that they are afraid in there
own home and have a real difficult time trying to do anything about it
because they have difficulty with a language barrier (they are Hmong).
She says her children can only play in a small fenced part of there yard
because i£ they are not in that part then the people living in the
apartments are threating & scaring them.
We-live here too, we pay property taxes and we should NOT have to
keep our children locked up in our homes. We have tried calling police on
distrubance calls, however, the last time we did they never showed up.
I know they are busy and especially on Friday and Saturday nights,
whiah is when it gets REALLY bad around here. I know also that they
can only provide a temporary fix for these problems.
As a homeowner myself, I know that I am responsible for keeping my
yard & sidewalks clean. If I have trash all over my yard the city could
demand that I clean it or have it done for me & charge me. Also as a
homeowner and a parent it is my responsibilty to keep my children from

myself, I need your help!

Gerry Strathman statcd he is not troubled by thc fcnce being 42 inches instead of 48 inches
because 42 inches should keep a child out. If someone is that determined to climb over it, they
can just as easily climb over a 42 inch fence as well as a 48 inch fence. About the visibility of
the pool, Mr. Strathman stated he has seen situations where people have an opaque plastic
aftached to their chain link fence to prevent peopie from seeing through it and viewing the pool.
Mr. 3tzathman explained the location where he has seen this. Warren Ketola responded he had
not seen this type of installation, but small people can still see over a 42 inch fence as evident in
the photographs he had shown eazlier. Mr. Ketola stated the photographs were taken from ihe
eye level of a toddler.
Gerry Strathman granted a variance with respect to the fence on the condition that the ladder and
any other device used to get into the pool will be locked up when the poo] is not being used.

Robert McClay and Wendy I.ee appeared. Mr. McClay stated petitions were filed concerning
deficiency/correction lists issued by Fire Prevention. In some instances, the items do not warrant
citations by the City. Some items are cosmetic matters that do not rise to the level of health and
safety which is the purpose of the housing code. Gerry Strathman responded the housing code
also deals with appearance. Mr. McClay stated Wendy Lee is here to testify on the Case
addresses. The person who is best able to testify on behalf of the Sims addresses is at the site
right now with personnel from Fire Prevention. Pat Fish concurred that staff was llaere.
Gerry 5trathman stated he has documents received on July 30 that have handwritten notes on
most of the items and asked what they are. Pat Fish responded the handwritten notes aze from
the inspector Barb Cummings. It is Fire Prevention's contention that items cited more than ten
days ago from previous inspections were not appealable. Mr. Strathman stated he will hear
everythang that needs to be said. Robert McCiay stated he did not have a copy of this July 301ist.
Mr. Strathman had copies made and gave Robert McClay and Wendy I,ee time to review the
document.
(This matter was discussed later in the meeting.)
905 Westminster Street
William Wilcox, owner, appeared. The garden level apartment windows are too high. They are
50 1/2 inches and are suppose to be 48 inches. A step could be built, but Mr. Wilcox does not
think that is going to last. Mr. Wilcox asked why the City changed the ordinance. Pat Fish
responded the ordinance did not change. The numbers aze so close that the inspectors might have
thought it was 48 inches. Mr. W ilcox stated every window has a baseboazd register underneath
it.
Gerry Strathman granted a variance with respect to the windows.

Each item on the deficiency/correction lists for the Case Avenue buildings were reviewed.
Wendy L.ee explained which items were done and which were not done.
Robert McClay suggested ]aying over the addresses on the Sims buildings because the two
people that know the most about it, as mentioned earlier, aze on site inspecting the addresses.
Gerry Strathman responded he was very concerned about any furttter delay because there seems
to be a pattern of neglect. Some items are reoccurring, however some items were cited June 4
and had not been done by July 14. The goal is to bring the building under compliance with the
code. .
Mr. McClay stated it seems it would be useful to identify the items not done and deternune
whether they are health and safety items or cosmetic items. Mr. Strathman responded his role is
to review the actions of the Fire Department. By filing the appeal, the owner has said those
actions are improper. However, the actions of the Fire Department are sufficient to make a
revocation of the certificate of occupancy a reasonable action.
Mr. McClay stated due process would warrant that Mr. Strathman finish hearing the case and
understand what the specific deficiencies are and weigh those in the context of the decision Mr.
Strathman is charged to make. Mr. Strathmaa stated that is what he is doing, but his role is not to
evaluate each decision the fire department made on each specific violation. His role is to see
whether there is reasonable cause to believe the Fare Department has acted contrary to the facts or
contrazy to the city ordinances. If the property owner is not properly notified, that would be a
deficiency. If the allegations the Fire Department used are all false and if the situations did not
exist, that would be a basis. However, no one is contending these things are not true. The owner
was notified, the items are true, and the opgortunity to correct was given. Mr. McClay stated
there was more testimony he wanted to give, and he had not rested his case. He requested that
Mr. Strathman consider whether these items are germane to a matter as serious as a certificate of
occupancy revocation.
Each item on the deficiency/correction lists for the Case Avenue buildings was reviewed again.
Gerry Strathman asked why people are being evicted in August and not eazlier than this. Wendy
I.ee responded because a lot of the residents aze on the 5ection 8 program. A lot of leases are
coming up for renewal. Ms. Lee just took over the Case addresses in April. Mr. Strathman
asked is she suggesting the buildings will be straightened up now that she is managing the
building. Ms. L,ee responded yes. She has attended the multi housing program with the Saint
Paul Police Depaztment Force Unit, the buildings are getting security, she is meeting with the
owner to get cazetakers instead of a cleaning company, and is screening people in a different way
than the former property manager.

Robert McClay stated there was a criminal matter that was settled in Mazch; he explained the
matter in detail.
Pat Fish stated the key to the problem is on site people. There needs to be some presence on the
property. Wendy I,ee reiterated that she is talking to the owner about this.
Gerry Strathman laid over this matter to the September 1 Property Code Enforcement meeting.

In 1990, the City/HRA work with Twin Cities Housing Development Corporation in putting
together the St. Paui Affordable Housing Development. This development included three major
housing complexes: Westmister Gardens (1319-1375 Westminster, 108 units; Flandrau Court
(1741-1501 Sims, 18 units; and Birmingham Woods (1426-1436 Case, 24 units).
7he financing package was as follows:
$3,160,000 ist mortgage loan bond (Fannie Mae)
637,000 Mpls./St. Paul Family Housing Fund
185,000 MHFA (Minnesota Housing Finance Agency)
547,000 HRA/Ciry
Properties went into foreclosure in .October, 1993. Indications were that the property at
Westminster caused the default of the overall financing package. Properties were packaged as
a fire sale after the toreclosure. HRA/City approved write off of loan in August, 1995.
Based on the funds put in by HRA of $547,000 spread over 150 unints, the gap per unit is
$3,646.66. However, in talking with Gary Peltier, a majority of the rehab was done on Flandrau
� Court to convert 36 units down to 18 units for large families.

As a member of the Saint Paul City Council, I am well aware of the need to provide decent and
affordable housing for the many hardworking families who ]ive in the city. I believe that one of the
goals of our community should be to preserve affordable rental housing tha[ is already in existence
to a quality and standard that enhances the lives of lts residents and the neighborhood. That the
preservation of affordable housing units need to be considered in the context of its surraundings and
the need for the units to be preserved. L.arge family units aze in great demand and no new
construction of three plus bedroom units are being built.
• The Birmingham Woods development represents the vuiety of rental housing that we need to
preserve and enhance. The development houses twenty-four working families in units that are large
enough for their families' needs. It is essential to provide safe and sanitary housing for families who
are not yet ready to move into homeownership opportunities with their families. However, in
addition to preserving these needed lazge housing units, it is essential that support services and on-
site management aze a strong component in the development. That resident participation in the
maintenance and quality of life issues must be strongly enforced in order to provide good
neighborhood housing and stabiliry to the azea. Management and residents must play an active rale
in this enforcement either in the concept of cooperative ownership housing and/or strong leases that
allow for immediate action.
I strongly endorse North East Neighborhoods Development Corporation and Real Estate Equities'
efforts to stabilize this property and retain this much needed family housing in the Greater East Side
neighborhood.

These buildings have been problems for our neighborhood £or many yeazs. These poorly
maintained apartment buildings have long had a detrimental impact on the surrounding
• neighborhoods. Nearby residents work hard to keep their homes looking nice. They complain that
the lack of upkeep at these buildings makes their e�orts futile: They ere generally proud of their
East Side neighborhood, but are embarrassed to take visitors around these apaRments. Neighbors
are tired of the tcash from these buildings blowing through the neighborhood. They are also tised of
having to call the city and register comptaints just to get basic maintenance done. Some former
residents have cited these apartments as a major reason for sel]ing their long-time homes and
moving to the subuzbs.
These buildings havc been a problem for too long. Hazel Park ces"sdents are extremeSy frustrated and
angry about the lack of progess on these apartment buildings. Please support the residents of
Haze1 Park by holding these landlords responsible for the condition of their buildings.

This letter is concerning the �'landrau Court and Bimvngham Woods apartment units. I
would strongly urge the council to hold these units to the highest possible standards of
enforcement.
I live near the Flandrau Court apartments. My spouse and I moved in from the suburbs a
little over four years ago. We were attracted by the wonderful oid houses in the Fiazel
park area. We have gitven a few interviews to the tocal papers regarding our move. We
really love our house, but the stress and fear caused by these poorty managed and
maintained units are causing us to consider moving.
We have seen constant drug deali�sg on the screet &om these buildings. We have our
sleep distwbed constantiy by fights in the parking lot, cars and taxis honking theit homs,
and yelling and xreaming by tenants and gvests. On more than on occasion we have
awoken to gunshots in the middle of the night and in one instance wimessed the aRezmath
of a shooting.
• Pear of harassmeat and fear for personal safety cause us to avoid these areas. This is no
way to live. I have devoted many hours of my personal time to help this community, but 1
sometimes feel my efforts are wasted while these units are allowed to continually do quick
fixes, then quickly degrade back to the usual poor condition. I and others aze putting off
improvements to our homes beoause of this. We are worried about throwing good money
after bad.
The destructive force poorly managed and maicrtained units do to the neighborhood
cannot be overestimated. They are destroying this area. I do oot want to move but I fee)
my hand 'zs being forced "�'his could be a beautiful neighborhood if not fo� this in our
midst. pnce again, I urge you not to let these people slip out of their responsibilities and
hope you hold them to the highest possible standards.

I'm looking for help. I am very frustrated and don't know where to go for
help. I live on Sims Ave, 1 block west of White Bear Ave and we have
some serious problems with the residents in the Apartment complex on
our block. This problem has been around for the last few years but it
has beinq increasingly worse and worse.
The entire block on Sims Ave between White Bear.Ave and Flandrau is
£ilthy. There is trash all over the place, a 1ot of it blowing into my yard &
left for me to clean up.
There is glass on the PUBLIC sidewalks to when ahildren are walking to
the elementry school (Case & White Bear) they have to walk through the
glass or in the streets.
Children living in these apartments are not watched by their parents, and
even some that are being watched by adults are destroying property of

We have just this week had our basketball hoop ripped out and left in our
driveway by these children. Our neighbors have had children climb on
their garage roof & tear shingles off the roof. From the time we come
home from work until sometime between 10pm and midnight (sometimes
later) we hear constant yelling, screaming, fighting and worse of all
EXTREAMLY VLTLGAR language.
When trying to drive down the street to leave and to come home we
usually have children playing in the middle of the street and refuse to
move for traffic.
The residents of these apartments ignore the stop sign at the corner of
Sims & Flandrau and many times speed by VERY fast. Car radios are so
loud at times that my entire house shakes from the vibration.
A week ago we had a resident from these apartments that was
intoxicated, blocking traffic and threating everyone within site. He
urinated in £ront of our home, we had called the police & it took over 45
minutes for them to come.

I talked to another private homeowner on our street. They also are just ��'
as frustrated as myself. She shared with me that they are afraid in there
own home and have a real difficult time trying to do anything about it
because they have difficulty with a language barrier (they are Hmong).
She says her children can only play in a small fenced part of there yard
because i£ they are not in that part then the people living in the
apartments are threating & scaring them.
We-live here too, we pay property taxes and we should NOT have to
keep our children locked up in our homes. We have tried calling police on
distrubance calls, however, the last time we did they never showed up.
I know they are busy and especially on Friday and Saturday nights,
whiah is when it gets REALLY bad around here. I know also that they
can only provide a temporary fix for these problems.
As a homeowner myself, I know that I am responsible for keeping my
yard & sidewalks clean. If I have trash all over my yard the city could
demand that I clean it or have it done for me & charge me. Also as a
homeowner and a parent it is my responsibilty to keep my children from

I work 45+ hours a week, go to school 2 nights a week & have 2 children
to raise. I don't have a lot of spare time to cre�te a neighborhood
crimestoppers chapter or to call every city official to solve this problem
myself, I need your help!
