PAUL��ie "City" an e N THE UNIVERSITY OF MINNESOTA (the "University") . WHEREAS, the parties hereto entered into an Agreement dated May 11, 1966 (the "Agreement") whereby the City agreed to provide Fire Services to certain University properties located outside the limits of the City of St. Pa�rl , specifically, that portion of the University's St. Paul Campus located in Falcon Heights , and the University agreed to reimburse the City for such services in accordance with the formula described in the Agreement, during the period of January 1, 1966 thraugh December 31 , 1970, and WHEREAS, the term ofi' the Agreement was extended Five (5) years, January 1, 1971 through December 31 , 1975, pursuant to an Agreement dated April 26, 1971 , and WHEREAS, the Agree�nent was amended to include Emergency Ambulance Services (Paramedic Units) , �effective January 1, 1975, and the term extended through December 31, 1980, 1and WHEREAS, the Agreel ent was amended effective January 1, 1978 to revise the calculation fon th,� reimbursement by the University to the City for Fire and Ambulance Services� (Paramedic Units) provided pursuant to the Agreement, and WHEREAS, the Agree� ent was amended to include additional University properties (located in Lauder ale) , effective April 1, 1983, and WHEREAS, the Cit� has continued to provide Fire, Emergency Ambulance and Paramedic Services� to said University properties in Falcon Heights and Lauderdale and the University� has continued to reimburse the City for said services pursuant to the Agreement,jand WHEREAS, the part,�ies hereto desire to continue the Agreement on a year-to-year basis, include the services of the St. Paul Hazardous Materials Response Teams effective July 1 � 1989, and reduce the University properties to be covered by the Agreement ef�ective February 1, 1990; NOW, THEREFORE, �he City and the University agree as follows : 1. The Agreem� nt dated May 11 , 1966 , heretofore amended, between the City and the University �hall continue on a year-to-year basis, July 1 through June 30, subject to termilnation by either party upon a written notice of at least Ninety (90) days . . I 2. EffectivejJuly 1, 1989, the Agreement shall include the services of the City's Hazardo�is Materials Response Teams (in addition to Fire, Emergency Ambulance and Paramedic Services provided by the City) . 3. Effective February 1, 1990, the Agreement shall cover the following University properties (the "Properties") : ^�.� '� �' ^ ' �~ � ' � ( O_ V / � That portion of the University's St. Paul Campus and Agricultural Experiment Station located east of Cleveland Avenue and south of Larpenteur Avenue in the City of Falcon Heights. . � The properties identified as 2520 Broadway Drive (University Computer Facil ity� and 2531 West Sumner Street (formerly occupied by Lightning and Transients Research Ihstitute) , Lauderdale. (The City and the Univ�ersity acknowledge that effective February 1, 1990 the City of Falcon Heights has agreed to provide Fire Services , etc. to the University properties in Falcon Heights excluded from this Agreement as of February 1, 1990.) 4. The City will provide the University quarterly reports describing runs or calls to the Properties pursuant to this Agreement for Fire, Emergency Ambulance, Paramedic and/or Hazardous Materials Services (including purpose of run or call , building involved, result of the run or call , etc.) . 5. The Universit,�'s reimbursement to the City for such Fire, Emergency Ambulance and Param dic Services and Hazardous Materials Services pursuant to the Agreement, due i�i advance upon receipt of appropriate invoice, shall be the sum of �32,946.36 fbr the period of July 1, 1989 through January 31, 1990 and the sur. of $17 ,649.�3 for the period of February 1 through June 30, 1990. The reimbursement shall be the sum of #48,418.00 for the period of July 1, 1990 through June 30, 19 1, and shall increase at the rate of 2.5 percent each fiscal year thereafter thi Agreement remains i� effect. 6. Al l other ter�ms and cond it ions of the Agreement dated May 11 , 1966, as amended , shall con�'inue of full force and effect.
