90-490 . . `� ���,�,�/u��un�� �0 R��i G I N i� 1... � • 3��ouncil File # 9� ��{J�� � ' - � Ordinance ,� ��en�e� �-� �c���t D ��� �S Green Sheet ,� .�fo��J� P�,t,�j(:c ORDINANCE ITY OF SAINT PAUL, MINNESOTA P sented By ' Referred To -�:LGt-cl�c- Committee: Date —��� Q 1 2 An Ordinance To Protect The Stratospheric Ozone Layer By estricting The 3 Use And Emissions Of Ozone-Depleting Compounds 4 5 WHEREAS, available scientific evidence indicates hat chlorofluorocarbons 6 ("CFCs") and Halons, when discharged into the/�nvironment, deplete and 7 degrade the earth's protective ozone layer,;'�allowing increased amounts of 8 ultraviolet radiation to penetrate the �arth's atmosphere, thereby posing / 9 an acute and immediate danger to hum health, life and the environment. 10 Available scientific evidence indi ates an increase in ultraviolet 11 radiation will result in seriou irreparable damage to all living 12 tissues, increasing such ha as skin cancers, cataracts, suppression of 13 the human immune system, d age to crops and aquatic life, and related . 14 harms. 15 16 WHEREAS, the Mon eal Protocol on Substances that Deplete the Ozone 17 Layer (an interna ional pact) which was ratified by the United States on 18 April 21, 1988, and which became effective January 1, 1989, calls for 19 reductions i the production, importation, and exportation of CFCs to 20 fifty perce t (50�) of the worldwide 1986 levels, by 1998, and for a 21 freeze on the production of Halon at 1986 levels beginning January 1, 22 1992: 23 1 � � 0 �,l���q � �g°"`��° 1 , , cent discoveries have shown that the reductions in CFC ✓ 2 levels set forth in the Montreal Protocol are insufficient to remedy the 3 global health and safety risk created from the release of CFCs and 4 Halons; 5 6 WHEREAS, in light of the current and future limitations on the 7 production of CFCs both nationally and internationally, the development 8 and utilization of environmentally safe alternatives to CFCs at this time 9 will create a competitive advantage to those businesses electing to 10 utilize such alternatives prior to the effective date of any 11 comprehensive international, federal, state or local regulation banning 12 the use of CFCs and Halons; 13 14 WHEREAS, the release of CFCs and Halons into the atmosphere is a 15 global danger to the environment, thus any reduction in the release of 16 said materials within the City of Saint Paul will reduce this global 17 danger and will result in a benefit to the overall health and safety of 18 the public inside and outside the City of Saint Paul; 19 20 WHEREAS, the City of Saint Paul encourages the research and 21 development of environmentally safe alternative technologies and products 22 to replace the use of CFCs and Halons; 23 24 WfiEREAS, the City of Saint Paul supports all international, federal, 25 and state bans on uses of CFCs; however, until such bans have been 26 adopted by the appropriate agencies, responsible action on the part of 27 the City of Saint Paul is necessary to reduce CFC and Halon use in order 28 to promote the long-term health, safety and welfare of the general 29 public, and the environment, and 2 1 0 � I l7 � �� ,'-°1 � � ° C�9� ��d✓ 2 WHEREAS, to protect the environment, and the health, safety and 3 welfare of its citizens, the City of Saint Paul herein, by this Ordinance 4 intends to prohibit the manufacture, sale and distribution of certain 5 products made of or with a blowing agent compound which consists of CFCs, 6 and to significantly reduce the release of Halons into the earth's 7 atmosphere; 8 9 WHEREAS, elected officials of the City of Saint Paul and citizens of 10 the City of Saint Paul have a right to know the specific sources of 11 emissions of CFCs and Halons emanating from their community; 12 13 NOW, THEREFORE, the City Council of the City of Saint Paul does hereby 14 ordain, that the Saint Paul Legislative Code is hereby amended to read as 15 follows: 16 17 SECTION 1 18 Chapter OZONE-DEPLETING COMPOUNDS 19 20 .01. Definitions. 21 For purposes of this Division, the following definitions shall apply: 22 23 (a) "Chloroflourocarbons", hereafter "CFCs", shall mean the family of 24 substances containing carbon, fluorene and chlorine, and having no 25 hydrogen atoms and no double bonds, and which includes, without 26 limitation, CFC-11, CFC-12, CFC-113, CFC-114, and CFC-115. Examples 27 of products containing or utilizing chloroflourocarbons are "Freon" 28 used in air conditioning and refrigeration units, degreasers and 29 solvents used in the cleaning of inetals and electronic components 3 1 � � � a�' �i��d an� flexible foam used in car seats, bedding, furniture, � 2 and insulation. 3 4 (b) "Halon" shall mean any fully halogenated carbon compound 5 containing bromine, chlorine, or fluorene, and includes, without 6 limitation, Halon-1301, Halon-1211 and Halon-2402. 7 8 (c) "Ozone-Depleting Compound", hereafter "ODCs", shall mean any CFC, 9 Halon, the chemical compounds of inethyl chloroform and carbon 10 tetrachloride or any other chemical compound hereafter designated by 11 the City Council by amendment to this Ordinance, as being an "ODC. " 12 13 (d) "ODC Food Packaging" shall mean any container, carton, box, cup, 14 lid, plate, bowl, tray or wrapping of any kind, which is or may be 15 used to contain, package, store, insulate or serve any food and/or 16 beverage, where any CFC has been used in the manufacturing and 17 production of such item. 18 19 (e) "Rigid or Flexible Foam Containing or Utilizing an Ozone-Depleting 20 Compound" shall mean any rigid or flexible foam, such as styrofoam 21 or thermoplastic foam, building insulation, or any other rigid or 22 flexible foam that contains within any closed cell any ODC or that 23 was produced by using an Ozone-Depleting Compound in any manner 24 during the manufacturing process. 25 26 (f) "City" shall mean all territory within the corporate limits of the 27 City of Saint Paul, County of Ramsey, State of Minnesota. 28 4 C�,,�q �'a 1� �'�(�I �� Council" shall mean the City Council of the City of Saint D� ` / , � V 2 Paul. 3 4 (h) "Person" shall include any natural person, firm, association, 5 partnership or corporation, whether acting as a principal, agent, 6 employee or otherwise, and includes any governmental entity or 7 charitable organization. 8 9 (i) "Establishment" shall mean any domestic or foreign corporation, 10 firm, association, syndicate, joint stock company, partnership of 11 any kind, joint venture, club common law trust, society or 12 individual engaged in any profession, trade, occupation and any and 13 every kind of calling carried on for profit or otherwise within the 14 City, including any governmental entity or charitable organization. 15 16 (j) "Licensed Health Care Facility" shall mean any health care 17 facility licensed either by the State of Minnesota Department of 18 Health or by the United States Department of Health and Human 19 Services. 20 21 (k) "Director of Public Health" shall mean the person in charge of the 22 Division of Public Health who shall be responsible for enforcement 23 of this ordinance. 24 25 . 02. Disclosure. 26 Every employer in the City where the business activity includes the 27 handling and use of ODCs in furtherance of the business activity shall 28 5 �9���a � ,� ,� � � �� �';(�� ���Y�in six ,montk�s after the passing of this ordinance, register a 2 notice with the Director of Public Health identifying the quantity, 3 types and uses of ODCs in the business activity; 4 5 (2) within one year after the passing of this ordinance, conduct and 6 submit an audit to the Director of Public Health which sets out an 7 amount of the ODCs used in the business activity, and identifies the 8 methods used for recovery and reclamation the of ODCs; and 9 10 (3) if such business activity is commenced after the one-year period 11 referred to in subsection (2) , register the notice required by 12 subsection (1) and submit the audit required by subsection (2) to 13 the Director of Public Health at the time of commencing operation of 14 the business activity. 15 16 . 03. Restrictions on the Manufacture of Equipment or Products Containing 17 Ozone-Depleting Compounds. 18 19 (a) No person in the City shall use any ODC in any process or activity 20 involving the manufacture, production, cleansing, degreasing, or 21 sterilization of any substance or product, except as otherwise provided 22 in this section. 23 24 (b) No person shall package any product with Rigid or Flexible Foam 25 containing or utilizing ODCs, except as otherwise provided in this 26 section. 27 28 (c) Exemptions: 6 (�g a--�C�b 1� � � ;��� ���s Sub�ection shall not apply if there is, at the time of � 2 manufacture, no commercially viable alternative to the use of the 3 ODCs, and there exists in connection with such manufacture, a properly 4 operating recovery system at the place of manufacture for the ODCs; 5 and an audit for ODCs has been conducted in accordance with 6 Subsection .02. 7 8 (2) This Subsection shall not apply to the study and/or research of 9 the effects of the release of ODCs into the environment and/or the 10 development of alternative technologies, where such compounds are 11 necessary for conducting such study and research. 12 13 (3) This Subsection shall not apply to any ODC used as a coolant in 14 any refrigeration or air conditioning unit or system. 15 16 (4) This Subsection shall not apply to any Licensed Health Care 17 Facility operated either for profit or not for profit, including any 18 medical research conducted at such facility, or to manufacturers of 19 any "drug" and/or any medical "devise" as the terms "drug" and 20 "devise" are defined in Title 21 U.S.C. Sections 321(g) (1) and 321 (h) 21 if the Federal Food, Drug, and Cosmetic Act, but only if the 22 manufacturer is required to comply with the Good Manufacturing 23 Practice requirements adopted pursuant to Title 21 U.S.C. Section 24 360j (f) . This exemption is valid until such time as safe and 25 effective alternatives to the current uses of ODCs by the Licensed 26 Health Care Facility or manufacturer of drugs and/or medical devices 27 are available as determined by the Director of Public Health and 28 approved by the Council. All manufacturers of drugs and/or medical 29 devises that utilize ODCs shall adopt and implement a recycling system 7 .a � �.� � p �Qp —c�'�0 1 � �'������ny ODC used as a sterilant by such manufacturers shall be ✓ 2 recaptured and recycled. 3 4 (5) This section shall not apply to any person manufacturing a 5 product or component product under contract with any branch of the 6 United States Armed Forces where applicable military specifications 7 require the use of an ODC. Such person shall adopt and implement a S reclamation and recycling program. 9 10 . 04. Restrictions on the Use of Rigid Foam Insulation. 11 No person in the City shall sell or install any rigid foam material 12 for building insulation that contains ODCs or with respect to which ODCs 13 are used as a blowing agent during the manufacturing process. 14 Simultaneous with the filing of a building permit application, the 15 applicant shall submit a written verification certifying that the 16 building insulation to be installed does not include rigid foam 17 insulation containing ODCs. 18 19 . 05. Disposal of Ozone-Depleting Compounds Contained in Building 20 Insulation 21 No person shall erect, construct, enlarge, alter, repair, move, 22 improve, remove, convert, renovate or demolish any building or structure 23 which requires removal of existing insulation that contains an ODC 24 without recovering and properly disposing of such insulation. 25 26 .06. Required Recapture and Recycling of Ozone-Depleting Compounds used 27 as Coolants in Refrigeration andJor Air Conditioning Units. 28 No Person in the City shall manufacture, service, or repair or permit 29 the manufacture, service, or repair of any air conditioner, air 8 �- � � � 90-��o 1i,,,��i` ������ system, chiller, refrigerator, freezer, refrigerating or � 2 cooling� equipment or system, unless such person ensures that any coolant 3 containing ODCs will be recaptured and recycled and not released into the 4 environment during the manufacturing, servicing, or repair process. 5 6 . 07. Restriction on the Sale of Specific Products Containing Ozone- 7 Depleting Compounds. 8 No person shall sell: 9 (1) Coolant containing ODCs for refrigeration or building or vehicular 10 air conditioning systems in containers with a total weight of less 11 than 15 pounds. 12 (2) Hand-held fire extinguishers containing ODCs for home use. 13 (3) Party streamers that contain ODCs. 14 (4) Electronic equipment cleaners, photographic equipment cleaners and 15 disposable containers of chilling agents that contain ODCs and that 16 are used for noncommercial or non-medical use. 17 18 . 08. �?isposal of Refrigeration or Air Conditioning Unit or System 19 Every person in the City who disposes of any refrigeration or air 20 conditioning unit or system that contains ODCs either in conjunction with 21 the disposal of another product, or in any other manner, shall only 22 dispose of such product or equipment 23 24 (1) by delivering such product or equipment to a recovery site 25 approved by the City or by delivering such items for disposal in 26 accordance with garbage collection procedures required by the City; 27 or 28 9 1�.�:�. �, , C��a-�d � �'(�2�I �i���suring tha� prior to disposal, the ODCs contained therein are � 2 drained and recovered from the product or equipment and thereafter 3 transported intact to a recovery site approved by the City. 4 5 . 09. Restrictions on the Manufacture and Sale of Aerosol Containers usina 6 Ozone-Depleting Compounds. 7 No person in the City shall manufacture or distribute aerosol 8 containers that uses ODCs as a propellant, except aerosol containers of 9 products used for medical purposes. 10 11 . 10. Permit Required for Testing Fire Extinguishing Systems or Units 12 Which Utilize ODCs. 13 No person in the City shall release ODCs in the training of personnel 14 or in the testing of any fire extinguishing system unless 15 16 (a) release of ODCs during testing or training is required by rule of 17 the federal government or one of its agencies, the state government 18 or one of its agencies, or a political subdivision of either the 19 federal or state governments; and 20 21 (b) the owner or lessee of the premises has obtained a testing permit 22 from the Director of Public Health in consultation with the 23 appropriate fire suppression authorities. 24 25 . 11. Reclamation of Ozone-Depletinq Compounds from Portable Fire 26 Extinguishing Systems or Units. 27 All establishments that repair, service, or perform maintenance on any 28 portable fire extinguishing system or unit shall adopt and implement a 29 reclamation system whereby any ODCs used as the extinguishing agent in 10 . , (,��a-� . � .�. , �, 1���� �i}� ;s�s�����r unit sh�ll not be released into the environment, but shall ✓ 2 be recaptured and recycled or properly disposed of. 3 4 .12.
