WHEREAS, The Saint Paul Police Relief Association is a
pension fund created by statute, and to whicYi police employee
members and the City, contribute sums of money to maintain the
fulfillment of its objectives, and
WHEREAS, The Association changed its by-laws on February 20,
1990, and Minnesota Statute 69.77 requires approval, by the City,
of the by-laws or amendments thereto, before they become effec-
tive, if the City contributes to �he pension fund, and
WHEREAS, the bylaw change eliminates a paragraph which
precluded a retired member, who is receiving retirement benefits,
from concurrently receiving survivor benefits which would have
otherwise been payable, had the survivor not been a retired
member of the police department, and
WHEREAS', an actuarial valuation has been obtained indicating
this modification should not cause a material financial impact to
the Saint Paul Police Relief Association, and
WHEREAS, the amendments to the by-laws are attached hereto,
now therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
approves of the association by-laws as amended, which are
attached hereto and incorporated by reference.

(m) No member who has been convicted of a felony shall be
entitled to such pension during the period of his/her
incarceration in any penal institution as punishment for the ���>,c��i�
commission of such felony; provided that no surviving spouse ,
or child under 18 years of age , of any member who shall have
been so convicted of a felony shall be deprived or their
pension rights by reason thereof unless such surviving spouse
or child shall have been a party to the commission of such
felony, and provided further that where such member so
convicted of a felony is receivino a pension at the time of
his conviction, his/her surviving spouse or child under 18
years of age , who has not been a party to the commission of
such felony shall receive the pension provided for herein in
the event of the death of such member.
For the purposes of this section, ail provisions
governing a child under 18 shall be extended to include a
full time student under the age of 23 .

(n) l��n In the case of any applicant for a service pension
who following his/her entry into the service of the police
department , has served in the military forces of the United
States in any war or national defense emergency subsequent to
January 1 , 1940 , and thereafter returned honorably discharged
from such service and resumed active duty in the police
department , the period that such applicant has served in such
military or defense emergency service shall be counted in
computing the period of service herein provided for, but
during such period of military or defense emergency service
he/she shall not be considered as an active member of this
association �nd shall not be entitled to any disability
pension for disability incurred in such military service .
(o) ,(��/ Time off duty because of suspension or removal sha11
not be inc2uded in computing the service of a meaiber. Time
off duty because of leave for personal business shall not be
included in service , nor time off duty because of illness if _
such time exceeds the 15 days per year allowed each employee
or the accumulated sick leave with pay allowed employees .

The Police Relief Association by-laws contained a paragraph which prevented a member from
receiving two separate pensions from the association concurrently. For example, if a
husband and wife were both members of the plan and began drawing their respective retirement
benefit, when one died, the other was not eligible to draw the survivor benefit.
