90-415 0 � I �I N A L Council File # � ��,7 Green Sheet # RESOLUTION - CITY OF SAINT PAUL, MINNESOTA z� Presented By Referred To Committee: Date 1 A RESOLUTION CONCERIVING SECTION 519 OF THE 2 SENATE CLEAN AIR ACT OF 1990 (S 1630) 3 4 WHEREAS, in the past years, city and state governments have been establishing laws that reduce 5 emissions of the chemicals that destroy the ozone layer; and 6 7 WHEREAS, due to the City's responsibility to protect the public health, the City Council of Saint 8 Paul, Minnesota will soon consider an ordinance to phase-out most local uses of ozone depleting 9 compounds no later than 1992; and 10 11 WHEREAS, the Senate Clean Air Act of 1990 (S. 1630) would only stop full production of most 12 ozone depleting chemicals by 2000; and 13 14 WHEREAS, Section 519 of the Senate Clean Air Act would prevent state and local governments 15 from establishing regulations on ozone destroying compounds that are stricter, and thereby more 16 responsible, than this federal legislation; 17 18 NOW RE E, B RE LVED, t at the Ci Council f Sain aul c s upo Senat 19 Davi uren er an enator uentin B dick, No Dakot memb rs of t Senat 20 Co 'ttee the onme and Publi Works, t strike Se ion 5 form e Cle Air A ; 21 a d 22 23 BE IT FURTHER RESOLVED, that the City Council of Saint Paul urgently calls upon Senator 24 Durenburger and Senator Rudy Boschwitz to publicly oppose the preemption by the federal 25 government of state and local laws to protect the environment, except in such cases that these laws 26 are arbitrary or capricious; and � 27 28 BE IT FINALLY RESOLVED, that the Clerk of the City of Saint Paul send a copy of this 29 resolution to each of the above named Senators.at��th�i�-affices in Washington, D.C.
