An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps thereof
WHEREAS, Pursuant to Minnesota Statutes, §462.357 and §64.400 of the
Legislative Code, H.H.H. Company (Jack Welsh) duly petitioned to rezone a
parcel located on the east side of Albemarle Street, south of Rail Road Tracks
and north of Ivy Street being legal described as Lots 7, 8, 9, Block 13;
Hager's Subdivision of Walcott's Addition to Cottage Homes from R-4 to B-3 for
the purpose of permitting the reuse of the property for off-street parking and
loading area, the petition having been certified by the Planning Division on
November 24, 1989 as having been .consented to by at least two-thirds of the
owners of the area of the ,g,roperty,°t,q be� rezoned, and further having been
consented to by at least 67� 'of�the owners of the property situated within 100
feet of the total contiguous property within one year proceeding the date of
the petition; and
WHEREAS, The Zoning Committee of the Planning Commission on January 4, 1990,
p, g p p considering the rezoning petition, and
held a ublic hearin for, the ur ose of_,
pursuant to §107.03 of the Administrative Code, submitted its recommendation to
the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on January 12, 1990 and recommended that the City Council approve
the petition; and
WHEREAS, notice of public hearing before the City Council on the said rezoning
petition was duly published in the official newspaper of the City on February
3, 1990 and notices were duly mailed to each owner of affected property and
property situated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, a public hearing before the City Council having been conducted on
February 22, 1990, where all interested parties were heard, the Gouncil having
considered all the facts and recommendations concerning the petition;

THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l.
That the zoning map of the City of Saint Paul, Sheet Number 4, as
incorporated by reference in §60.301 of the Saint Paul Legislative Code,
as amended, is hereliy further amended as follows:
That property located on the east side of Albemarle between the Rail Road
Tracks to the north and Ivy Street to the south, being more particularly
described as:
Lots 7, 8, 9; Block 13; Hager's Subdivision of Walcott's Addition
to Cottage Homes
be and is hereby rezoned from R-4 to B-3
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

Dear Sir:
On January 4, 1990 the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 4 to 0 to approve the rezoning based on
staff findings.
On January 12, 1990 the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on February 22,
1990. Please notify me by February 20, 1190 if any member of the City Council
wishes to have slides of the site presented at the public hearing.

WHEREAS, t':. H. H. Company, file #10�82 , has petitioned to rezone Albemarle Street
south of the railroad tracks and north of I�^.- Street from R-4 to B-3 for the purpos;
of providing off-street parking and a loading area for a new commercial developmen�
on property to the east which fronts on Rice Street; and
WHEREAS, the Zoning Committee of the Planning Commission on January 4, 1990, held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact: �
1. A petition containing the signatures of twelve of seventeen eligible property
owners was received in the Zoning Office on November 15, 1989.
2. Following the seven working day waiting period required by Section 64.400. (c) of
the Zoning Code, the petition was declared sufficient on November 27, 1989. ,
3. Residential property to the north beyond the railroad right-of way is vacant.
Property to the northeast is developed with an industrial use. Property to the '
east is under development for a commercial use which requires additional
off-street parking and an off-street maneuvering area which can be provided if
this property is rezoned.
4. An approved site plan for development of the parking and maneuvering area is on
file in the Zoning Office. The approval of that plan is contingent upon
rezoning of this property. The plan provides for adequate landscape buffering
between this property and the adjacent residential property to the south.
5. Low density residential development of this property or other nearby R-4
residential property for low density residential uses is highly unlikely. The
parking and maneuvering area with landscape screening as proposed in the plan
will remove a neighborhood eye-sore and provide buffering to the residential
property to the south.

NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the
petition of H. H. H. Company to rezone property at Albemarle Street south of the
railroad tracks and north of Ivy Street more particularly described as Lots 7,
8 and 9, Block 13, Hager's Subdivision of Walcott's Addition to Cottage Homes, from
a R-4 zoning classification to a B-3 zoning classificatio�n is consistent with the
Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Commission does hereby
recommend to the Council of the City of Saint Paul that property located at
Albemarle Street south of the railroad tracks and north of Ivy Street be rezoned
from R-4 to B-3 in accordance with the petition for rezoning on file with the Saint
Paul Planning Division.

A. PURPOSE: To consider rezoning property from R-4 to B-3 to provide off-street
parking and loading area for a new commercial development on property to the
east which fronts on Rice Street.
B. PARCEL SIZE: The property has approximately 121 feet of frontage along the east
side of unimproved Albemarle street and a depth of approximately 125 feet. The
area of the parcel is approximately 12,697 square feet.
C. EXISTING LAND USE: The parcel is presently vacant. There is some sparse
vegetation at the westerly end of the parcel. The property is typically
overgrown with weeds during the summer season.
D. SURROUNDING LAND USE:
North: Railroad right-of-way and vacant R-4 residential land
East: A new building under construction on B-3 zoned land
South: Low density residential development on R-4 zoned land
West: Vacant R-4 zoned land.
E. ZONING CODE CITATION: Under the provisions of Section 64.400 (a) of the Zoning
Code, " the council may, from time to time, amend, supplement or change the
district boundaries or the regulations herein, or subsequently established
herein pursuant to the provisions of Minnesota Statutes Section 462.357 and
amendments thereto as may be made from time to time. . ." . Section 64.400 (b) of
the Zoning Code states in part that " . . .an amendment to the zoning code may be
initiated by the council, the planning commission or by petition of the owners
of sixty-seven (67) percent of the area property to be rezoned.
