wHERE�S, Paige Hammernick (David Dobis) , has submitted thz attaclied proposed

WHEREAS, the Department af Planning and Economic Development and Public Yrorks
have reviewed the proposed lot split located at 362 West Minnehaha and 707
Virginia Street, as described on the attached survey; and
WHEREAS, the proposed lot split meets the requirements of Chapter 6i.304 of tlie
Zoning Code, except for rear yard setback requirement of 25 feet; and
WHEREAS, notice of public hearing before the City Council was dul� published in
the official newspaper of the cit� and notices were mailed to each owner of
affected property and property situ�ted wholly or partly within 350 feet of the
subject property; and
WHEREAS, a public hearing uetore the City Council was held on March 1, 19yU,
where all interested parties were heard, the Council having considered all the
facts and recommendations coucerning the lot split with variance;
NOW, THEREFORE, BE IT RESOL�'ED, that the City Council accepts and appro��es the
lot split located at 362 West Nlinnehaha and 707 �`irginia Street, with variance
f'or the rear vard setback; and
BE IT FliRTHER RESOLVED, that a copy of this resolution will be mailed by the
Gity Clerk to the a�plicant at �41 Hillwind Road NE, Minneapolis '�SN 5543`L,
Planning Administrator and to the Zoning �dministrator.

A. PURPOSE: To consider a lot split with variance to permit division of two
parcels into two separate lots with different configurations to remove an
existing encroachment.
A variance is requested because single family homes in a RT-1 zoning district
' require a 25 foot rear yard setback from the rear lot line. One of the proposed
lots would have a rear yard setback at 14.84 feet. A variance of 10.16 feet is
; requested.
! B. SITE & AREA CONDITIONS: The site has one single family residential building, two
detached garages and an encroachment of anotlier single family home on one of the
lots. The other lot has one single family residential building. The lot split
would split off a west parcel which would include one single family home and
both the garages. The east parcel would require the variance described above
and would have only one of the single family home on this lot. This lot split
would clean up the encroachment of the residential building. The adjacent
properties to the north, east, south and west are developed with single family
, residential homes.
, C. MINIMUM LOT REOUIREMENTS: Minimum lot size required for a single family home in
� RT-1 district is 5,000 square feet.

D. CURRENT WIDTH AND AREA: The current width of the northern parcel is 41.5 feet
with a lot size of 5,747 square feet. The current width of the southern parcel
� is 37 feet and with a lot size of 5,124 square feet.
E. PROPOSED WIDTH AND AREA: The proposed width of the western parcel is 69.25 feet
with a lot area of 5,389 square feet. The proposed eastern parcel would have
78.9 feet of frontage with a lot area of 5,439 square feet.

F. REOUIRED FINDINGS:
l. The requested lot split meets the requirements of Section 67.304 of the
zoning code except for rear yard setback, for a single family residential
building in a RT-1, T�o-Family Residential District.
2. The City Council may grant a variance from the subdivision regulation when
compliance would create an unusual hardship, based on findings stated in Section
67.703 of the zoning ordinance. These findings and the applicant's ability to
meet them with the current proposal are as follows:
a) The intent of the subdivision chapter is met.
The intent of this chapter is to provide for a orderly, economic, and safe
development of the land. This intent can be met with the proposed lot
split. The lot split would create two separate parcels that are already
developed. The home built on the north lot facing Minnehaha Avenue
encroaches on the lot to the south. This lot split would remove this
encroachment but would require a rear yard setback variance. .
b) The granting of the variance wi11 not be detrimental to the public safety,
health or welfare or injurious to other property or improvements in the
neighborhood in which the property is located.
The lot split will have not have an adverse impact on the adjoining
properties.
c) The conditions upon which the request for a variance is based are unique
to the property for which the variance is sought and are generally not
applicable to other properties.
The conditions upon which the request for the variance is made are unique
to this property.
d) The special conditions and circumstances do not result from the actions of
the applicant.
The conditions and circumstances are not the results of actions by the
applicant
e) Unusual hardship to the owner would result, as distinguished from a mere
inconvenience, if the strict letter of these regulations was carried out.
Because of the current encroachment of the house facing Minnehaha Avenue,
it is not possible to provide marketable title for either of the
properties. This is an unusual hardship which will be remedied if the
lot split with variance is approved.
G. STAFF RECOI�IIytENDATION: Based on the above findings, staff recommends approval of
the lot split with variance.
