C TY F SAINT PAUL, MINNESOTA � ,; • Presented By Referred To Committee: Date RESOLVED , that upon the petition of Catholic Charities of the Archdiocese of St. Paul and Minneapolis, per Finance Department file no. 21-1989 , those parts of Old Sixth Street and North Exchange Street hereinafter described be and the same are hereby vacated and discontinued as public right-of-way: The vacated areas are described as follows: That part of Old Sixth Street and North Exchange Street which lies within the. following described lines : Commencing at the Southwesterly corner of the South one-half of the East one-half of Lot 11, Block 4 , Rice and Irvines Addition to St. Paul; thence South 82 degrees 34 minutes 43 seconds East (assumed bearing) along the southerly line of said Lot 11 a distance of P1. 36 feet to existing building face and the point of beginning of the lines to be herein described; thence South 7 degrees 18 minutes 36 seconds West 1. 40 feet; thence South 82 degrees 34 minutes 43 seconds East parallel with southerly line of said Block 4 a distance of 92. 30 feet to a point 1. 4f� feet easterly of the East line of said Block 4; thence North 7 degrees 23 minutes f�2 seconds East parallel with the East line of said Block 4 a distance of 68 feet, more or less, to the easterly extension of the North face of the existing building; thence North 82 degrees 34 minutes 43 seconds West 1 .4 feet along the said north face of building and its easterly extension to the East line of said Block 4; thence South 7 degrees 23 minutes 02 seconds West along said East line to the Southeasterly corner of said Block; thence North 82 degrees 34 minutes 43 seconds West along South line of said Block 4 to the point of beginning. This vacation shall be subject to the following conditions : l. That the vacation be subject to all the terms and conditions of Chapter 13P1, codified March l , 1981, of the Saint Paul Legislative Code, as amended. 2 . That the land described above is being vacated to accommodate building encroachments and that upon removal , reconstruction, alteration, demolition, or otherwise non-existence of the encroaching building, the vacated land shall revert to the City of Saint Paul as street right-of-way without cost of charges to the city. 3 . That the petitioner , its successors , and assigns shall pay the city $5�0. 00 as compensation for this vacation which is due and payable within 60 days of the publication date of this resolution. 4 . That a permanent utility easement be retained within the vacated area to protect the interests of District Energy St. Paul, Inc. 5. That the petitioner , its successors, and assigns , by acceptance of the terms and conditions of this vacation agree to indemnify, defend, and save harmless the City of Saint Paul, its officers and employees from all 2 ORIGI �� A1� � � � - � � ���-��` suits , actions , or claims of any character brought as a result of injuries or damages received or sustained by any person, p�rsons , or property on account of this vacation or petitioner ' s use of this property, in'cluding but not limited to a claim brought because of any act of omission, neglect, or misconduct of said petitioner because of any claim or liability arising from any violation of any law or regulation made in accordance with the law whether by the petitioner or any of its agents or employees. 6 .
