to the City, in a form to be approved by the City Attorney, the
proper City officers are hereby authorized and directed to pay
out of the Tort Liability Fund 09070-051-00000 , to :
l . Webster Co. , Inc . the sum of $1 , 742 .85 in full settlement of
its claim of damages sustained on or about July 19 , 1989 , as
more particularly set out in the Notice of Claim filed in the
City Clerk 's office on January 8 , 1990 .

On July 19 , 1989 , a City of Saint Paul Public Works inspector mismarked
the existing sewer location for 1912 Portland Avenue. AS a result of
this mistake, Webster Co. employees , who were drilling for a new water
service for this residence, accidently struck and broke the sewer line
for this address . It was later determined that the existing sewer line
was 7 feet from the marked location . Webster Co. replaced the sewer
line for an additional charge of $1 , 742 .85 . Public Works admits it was
