WHEREAS , the City of Saint Paul by Council File No. C .F .
117833, adopted April 10 , 1940 , acquired a temporary construction
easement over a strip five feet in width on the west side of
Lot 53 , Block 6 , Smith' s Subdivision of Blocks 2, 6, 7 and
8 of Stinson' s Division of the northwest 1/4 of Section 36 ,
Township 29 North, Range 23 West, and also acquired a Warranty
Deed conveying this temporary easement to the City of Saint
Paul , recorded in the office of County Recorder in 1053 Deeds
109, Document No. 972074; and
WHEREAS , , the City has been asked to formally release
this temporary easement for the purposes of clearing the title
on behalf and for the owner of the subject property and the
administration recommends that the City Council approve and
authorize the execution of this Release of Temporary Easement ;
now, therefore , be it
RESOLVED, that the Council of the City of Saint Paul does
hereby approve and authorize the Mayor, Director of the Department
of Finance and Management Services and the City Clerk to execute
the Release of Temporary Easement for the property as above
described on behalf of the City of Saint Paul .

RELEASE OF TEMPORARY EASEMENT
The City of Saint Paul , a municipal corporation, a corpo-
ration of Minnesota, hereby releases the temporary easement
for use during the process of sewer construction on, over and
across the following described property in Ramsey County, Minne-
sota:
The Westerly 5 feet of Lot 53, Block 6, Smith' s
Subdivision of Blocks 2, 6, 7 and 8 of Stinson' s
Division of the N.W. 1/4, Section 36, Township
29 N. , Range 23 W.
This releases the above described property from the temporary
easement which was given by Warranty Deed from Harry B. Wieken
and Margaret Wieken, husband and wife, on May 20, 1940, recorded
for record on May 21 , 1940 , in 1053 Deeds 109 as Document No.
972074 and taken by condemnation under preliminary order 117194
approved January 23, 1940, and filed for record on May 31 ,
1940, in 53 plans 33 as Document No. 972670.
