1 WHEREAS, e St. Paul School District has sold Edgcumbe School, which has been the
2 location of the W Team Police Off'ice under a lease agreement with the School District,
3 causing the disl cation of the Team Police effective September, 1990; and

5 WHEREAS, t St. Paul Police Department has been searching for alternative sites for a SW
6 Team Police O�ice since summer, 1989 when it became known that Edgcumbe School was
7 available for salle and a buyer identified and has worked with PED, Parks and Recreation, and
8 the School Dist�ict in the search process, and has been in communication with District Councils
9 and community igroups to exchange information about the needs of the Police Department and
10 the community,''the concerns about disrupting open space and the absence of available land
11 and the financi 1 implications of relocating the SW Team; and

13 WHEREAS, n other available alternatives e�ust, there has been agreement between the Police
14 Department an the Parks and Recreation division for the construction of a building set back
15 from the "new" Highland Pool in Highland Park to house the SW Area Team Police, which
16 meets the nee of the Police Department and minimizes the intrusion onto park and open
17 space and thes plans have been shared with District Councils and community groups;

19 WHEREAS, d�ring the 1990 City budget process the CIB Committee reviewed this issue and
20 recommended �unds in Contingency and the City Council and Mayor approved placing $400,000
21 in CIB Contin ency for the purpose of financing a SW Team Police Office should it become
22 necessary to d� so; and

24 WHEREAS, op� February 8, 1990 the CIB Committee recommended approval of $400,000 in
25 CIB Continge�cy to be used for construction of a SW Team Police Office near the "new"
26 Highland Poolb

Re: Southwes$ Team Police Station/Highland Park
Dear Mayor Sc]heibel:
At the �resent time the southwest team police station is
located in th�e former Edgcumbe elementary school, which has been
sold by the �ndependent School District #625, and which must now
be relocated ' to another location. Last week the City Council
adopted a resolution to provide the necessary funds to construct
a replacement building to be located adjacent to the new swimming
pool located in Highland Park. The proposed site is on the
southeast corner of Edgcumbe Parkway and Montreal Avenue, and the
new building 'is to be constructed adjacent to and north of the new
outdoor swim�ning pool. The Council requested that the City
Attorney advise the administration whether there were any
restrictions 'on the City's title to the real property which would
prevent loca�ing the team police station at this site, and that is
the purpose �f this letter.

For reaspns set forth below, I am of the opinion that the
City' s title �o the real property does not preclude use thereof for
the team poli�e station.
The Finahce Department, Division of Valuations, has supplied
me with the flollowing information and upon which I have based the
above conclusjion. The legal description of the part of Highland
Park under cansideration is:
Thalt miscellaneous tract of land in the NW 1/4
of SE 1/4 of Section 15, Township 28 North,
Rar�ge 23 West, lying between Edgcumbe Road,
Montreal Avenue, C. W. Youngman's Addition,
Bohland's Addition and the Northerly line of
WeSt Seventh St.
This prmperty was condemned for park purposes by the City of
Saint Paul in 1925 under the provisions of section 233 of the City
Charter. Th� relevant portion of section 233 is as follows:
Se�. 233 . The municipal corporation of the
City of St. Paul, by and through its council,
is hereby vested with and authorized and
empowered to exercise the following powers:
(1� From time to time, to acquire for present
or' future public use by purchase, gift, devise
or! condemnation any and all lands or easements
th rein for the following public uses and
pu poses:
(a) For parks, public playgrounds, parkways
a boulevards; for public markets, public
b ildings, school buildings, hospitals, ***
a d for any other public purpose or use.

In addijtion to the condemnation proceedings the City also
obtained dee�s from the former owners conveying all their interest
in the prop�rty to the City. The deeds to the City have been
examined andl, no restrictions or conditions are contained in those
deeds.
The Ci�y was authorized by section 233 of the Charter to
acquire real property for park purposes, public buildings and any
other public' purpose. Acquiring the property for park purpose was
specifically! authorized by section 233, and the proposed team
police statilon is a public building within the authorization to
acquire property for "other public purpose".
When tlhe City acquires title by condemnation and by deed
pursuant to section 233 of the Charter, the City may use the
property for any public purpose, including park or police station.
The authori�y for this conclusion is the decision of the Minnesota
Supreme Court in Kendrick vs. City of St. Paul, 6 N.W.2d 449
(1942) .
In Kenc�rick the City condemned property for street purposes.
The City al�so obtained from the previous owner an unrestrictive
deed conve ing their interest to the property to the City.
Following c nstruction of the street, a portion of the property was
not needed � or street, and an adjacent owner improved the land as
a rock gard n for public use. Another adjacent owner wanted to use

the excess lar�d for his own private use, and obtained a deed from

the previous olwner. Then he argued that the City had abandoned its
street use an� therefore the City had no further interest in the
property. The Minnesota Supreme Court ruled that the City, based
on the fact tl4at title to the property was acquired under section
233 of the Ch�rter by condemnation and deed, with no restrictions
in the deed, �ould use this property for street purposes or park
purposes. Th� Court relied upon the provision of section 233 which
specifically �.uthorized acquiring property for "street" use as well
as for "park'� use. Section 233 also states that the City may
acquire property for "public buildings" as well as for "any other
public purposle or use" . The following is a quotation from the
Court's decis�.on:
We are not particularly concerned with the
que�stion whether or not the rock garden was a
"bolzlevard" in the narrow sense of being a
pub�ic thoroughfare. If not a boulevard, it
cer�tainly was a "park", though diminutive in
siz�e, within the meaning of the word "park" in
§23'3 of the St. Paul city charter authorizing
the� city "to acquire for present or future
pub,lic use by purchase, * * * any and all
lanids * * * for parks, public playgrounds,
parfkways and boulevards.
This opi;nion is consistent with a previous opinion issued to
the City Administrator on October 17, 1973, which stated as
follows:

In ' Kendrick v. City of St. Paul , supra, the
ci y condemned an easement for street
pu oses, and the owner delivered a warranty
de�d to the city conveying the land without
an reservations or restrictions on the use.
Th� court held that the City acquired fee
si�ple title through acceptance of this
wa ranty deed, and, therefore, the city could
us� the property for other public uses than
st�eet purposes.
In conc;�usion, it is my opinion that the City' s title to
Highland Par�C will permit the use of it for the proposed team
police stati�n.

The SW Team Police Site
The Neighbor_hpod Services Committee was scheduled to take this up
today, but thie meeting had to be cancelled. After discussion
with some Cou�cilmembers, and knowing the urgency of this matter,
I wish to hav�e the City Council act on this issue at the March 8
meeting. '
For your info�ation I am providing background on the site
selection wor�c that has occurred to date. This includes a
narrative of ithe process that began last fall, a site locations
map of the siftes at the Montreal/Hamline/Edgcumbe� Road area
within Highla�nd Park that were considered, the site plan and
costs for thq site that the Police Department is recommending as
the location ,for the new SW Team Office. This site has been
considered by! the District 14 and 15 Community Councils and the
community is ��satisfied that this is the best site for the SW Team
Police after �examining the information presented by the Police
Department ar�d Parks Division.
The preferenc�e of everyone - Police, Parks, the community and me
- was to remajin at the Edgcumbe School, but the actions of the
School Boardlin selling that building have forced the City and
the communit� to find another site for the Team Police. The
Police need �.o be out of Edgcumbe School on September l, 1990 so
it is impera�ive that we move quickly in order to allow
uninterrupte� Team Police service in the SW Area and to prevent
additional c sts for temporary moves.
At the City ouncil meeting there will be large scale drawings
and some sch matics of the site as it would appear with a
building on ite. Chief McCutcheon and Bill Armstrong from TKDA
will be pres nt to make the presentation and Bob Piram will be
present to c�mment from the Parks Division's perspective.

The followin sites were discussed:
Old Poo Site Bob Piram and others felt the cost to
� prepare this site would be too expensive and that the
old poo building should not be raised at this time.
� Ed ecumle and Montreal (same corner as new pool but
closer o the intersection) Bob Piram opposed this
site. I�e offered a suggestion to add on to the present
new pool� building. He stated the pool is open from
Memoria]� Day through Labor Day and that there would be
some cor�gestion during that period .
Clubhou e This remains as a viab�e option for
an addi ion to the clubhouse or for new construction.
Antonio Drive Bob Pir�am suggested a site near Antonio
Drive . He furnished drawings of the site. The Parks
Departm�nt would like to gain new public restrooms and
additio�al parking lot space with this proposal.
Placeme t of Park Rangers in this complex would also
be an o�tion. Bob pointed out that there are many
' drinkin parties in this area and the Team office would
elimina e this problem.

On this dat� I contacted the architectural firm TKDA. I
spoke with �les Hendrickson 292-4535 about preliminary site
plans . He �tated his firm does have a contract with the
city to per orm that function and gave me a price estimate
of $2500. f�r three sites. He �stated that if furter sites
were added �here would be additional costs, but because the
preliminary, work is complete the costs would be reduced. He
added the spil sampling would cost about $1000.
Hendrickson' gave a time estimate of 1 month to complete this
project. Ri h Gray, the landscape designer would be assigned
- this projec� by TKDA.

sites . The pur�ose of this was to-'allow him� to see the
present sites t� help him design the future SW team office.
On October 28, �989 I met with Sergeant Bruce Mead to brief
him on this pro ect. Mead has been unable to attend
previous meetin�s . I also asked Bruce to make rough
sketches of a t�am office as he thinks it should be built .
