WFIEREAS, the Council of the City of Saint Paul, in Council File 97-1568, as amended, —� –
adopted an interim ordinance prohibiting the establishment of new advertising signs and the
modification of eacisting advertising signs, pending the City's study of the need to establish
special dishict sign plans pursuant to Saint Paul Legislative Code § 66216; and
WHEREAS, Council File 97-1568 provided that applications for special district sign
plan applicarions may be initiated by filing an application with the director of the Department of
Planning and Economic Development; and
WHEREAS, Council File 97-1568 fiurther provided that only duly recognized
neighborhood district councils may apply for a special district sign plan; and
WFIEREAS, the following neighborhood district councils: 2, 3, 4, 5, 6, 9,10, 11, 12, 13
(Merriam Park and Snelling-Hamiine areas onty), 15 and 17, submitted applications far special
district sign plans pursuant to Councit File 97-15�8; and

WI3EREAS, Council File 47-1568 further provided that any objection to the filing of a
special sign district application must be written and would require a public hearing. The public
hearing would a11ow the Council to determine whether an application was reasonable, not over
inclusive, not discrisninatory, and would further assist the plamvng and legislative process
necessary for the adoption of special district sign plans for incorporation into the Saint Paul
Zoning Code; and
WFIEREAS, in a letter to Councilmember Dan Bostrom dated May 21, 1998, DeLite
Outdoor Advertising Inc. (DeLite) specifically objected to the special sign district application
from District 4 Community Council and generally objected to all other special sign district
applications. Delite requested that the matters be scheduled for public hearings; and
WHEREAS, pursuant to DeLite's request, the Council of the City of Saint Paul duly
scheduled a public hearing for July 8, 1998 with notice to affected parties; and
WHEREAS, on July 8. 1998, a public hearing on special sign district application as
provided pursuant to Council File 97-1568 was duly conducted by the City Council where all
interested parties were given an opportunity to be heazd; and

WHEREAS, the Council, having heard the statements made and having considered the
applications, the report of staff and the testimony produced during the public hearing,
DOES HEREBY RESOLVE:
That all the special district sign plan applications aze reasonable. Although each
application is geographically broad in that it encompasses the azea of the entire
district council boundary (except for the District 15 application that includes only
the boundaries of the Shepazd -Davem Forty Acre Study Area which is presently
underway) the applicarions aze nevertheless natrow in scope in that they address
only advertising signs which aze those signs located offpremises as opposed to
business signs which are on premise signs.
2. The prohibitions against the construcfion of new advertising signs or the
modification of existing advertising signs are also zeasonable in that the special
district sign plans aze designed to prevent construction of advertising signs under
today's regulations which might not be allowed if advertising sign regulations are
amended.
3. The prohibitions of these special district sign plan moratoriums are consistent.
The council finds that the prohibitions apply only to prohibit the construction of
new advertising signs or the modification of exiting advertising signs. It is
implicit that these prohibitions exclude bus shelter and bus bench advertising
devices as well public skyway advertising devices allowed under franchise
agreements pursuant to Saint Paul Legislarive Code Appendices I and J; and
4. Implementation of these special district sign plan moratoriums will fuither assist
the planning and legislative process.
BE IT FURTHER RESOLVED, that the interim regulations in effect by virtue of this
resolution and as required under Council File 97-1568 shall be deemed to expire at such tnne as
either new regulations are enacted by the council, or on December 31, 1999, whichever may
come first; and

BE IT FURTHER RESOLVED, that for the above-stated reasons, the specific and
general objections to the said applicafions by DeLite aze not supported; and
BE TT FINALLY RESOLVED, that a copy of this resolufion be delivered to the Saint
Paul Plauning Commission, the Legislative Advisory Committee reviewing cutrent advertising
sign regulations, the Zoning Aduiinistrator and DeLite Outdoor Advertising, Inc.

Dear Ms. Anderson:
PED requests the City Council to schedule a public heazing on the objection by Delite Outdoor
Advertising to requests for billboard moratoriums and special sign districts by the citizen participation
districts listed above. PED requests that the public heazing be scheduled on July 8, 1998.
Council File 9-1568 provides that district councils may request moratoriusns on advertising signs during
the time that the Advertising Sign Legislative Advisory Committee is working. The moratoriums
become effective automatically after 30 days if no one objects to them. If someone objects, the Ciry
Councii is to hold a public hearing within 30 days of the objection to determine if the district councils'
requests are reasonable, nondiscriminatory, supportive of the planning process for advertising sign, and
are not overly broad. Delite Outdoor Advertising, Inc. sent the CiTy a letter stating that they think the
requests are overly broad.

PURPOSE: To consider the objection of DeLite Outdoor Advertising to applications for Special
Sign Districts that include moratoriums on billboard construction and/or repair made by several
district councils pursuant to CF 97-1568, which was adopted on February 18, 1998.

Council File 97-1568 on advertising signs established a legislative advisory committee and
provided that district councils may apply for special district sign plans that impose interim
restrictions on signs untii the City Council decides whether to change city regulations goveming
advertising signs. Most advertising signs aze billboazds; a smaller number are bus benches and
bus shelters. The ordinance goes on to provide that district councils' applications for special
district sign plans become effective automatically after 30 days unless someone objects. If
someone objects, the City Council is to hold a hearing and decide whether the applications aze
reasonable and supportive of the legislative study process and are not over-inclusive or
discriminatory.
Staff recommends approval of the special sign district appiications and denial of the objection by
DeLite Outdoor Advertising, Inc.

A. Purpose: To consider the objection by DeLite Outdoor Advertising, Inc. to applications
for special district sign plans with moratoriums on billboard construction or modification by
District Councils 2,3,4,5,6,10,11,12,13 (Merriam Park and Snelling-Hamline), and 17, and to
decide by Council Resolution whether to approved these special district sign proposals.
B. Ordinance Citations:
Zoning Code, Sec. 66.216, provides for the creation of special district sign ptans that may set
tighter or looser sign regulations than the citywide regulations. Before 1998, three specia]
district sign plans were established for Grand Avenue, Smith Avenue, and Highland Village.
Council File 97-1568 is an interim ordinance that establishes a legislative advisory committee on
advertising signs and provides that special district sign plans can be created, upon application by
district councils, to preserve the status quo with respect to advertising signs during the ]egislative
study period. The applications by district councils become effective automatically afrer 30 days
unless someone objects. If someone objects, the City Council is to hold a public hearing and
decide whether to approve the special sign district applications. The following quotations are
from the ordinance:
"Applications. The term `application' shall mean and be limited to any written request by one or
more of the seventeen (17) district councils in the CiTy that the Council adopt a Special District
Sign Plan.... An application shall be in the form of a letter which describes the boundaries of the
area proposed for such a Sign Plan, and shall state in general terms the desired scope and
provisions ofsuch Sign Plan."(Lines 26-33)
"The term `objection' shall mean and include any written objection to such application." (Lines
34-35)

"Prohibitions effective on resolution. In the event of an objection, the prohibitions contained in �
this Section II will go into effect on the effective date of a Council resolution, adopted following
such public heazing, which resolution finds that such applicarion is reasonable and is not over-
inclusive, and that the said prohibitions are reasonable and not discriminatory and will further
and assist the planning and legislative process for the adoption of a Special District Sip Plan."

C. Findings:
I. Since Council File # 97-1568 was adopted on February 18, 1998, the Advertising Sign
Legislative Advisoty Committee has been appointed and has met regulazly since April.
Their goal is to complete recommendations by August 1, 1998 and present them to the
City Council. The Council will consider the recommendations and request review of
them by the Planning Commission. Then, it is likely that the City will adopt revised
regulations for adveRising sia s.
2. Between Apri12, 1998 and June 29, 1998, the City received 13 applications for special
sign districts from district councils. App(ica6ons are received by the City Council and
PED. As applications are received, PED notifies LIEP and other individuals who request
to be notified. Anyone may file an objection within 30 days, in which case the
application(s) goes to the City Council for a public hearing and decision.
3. Peter Coyle, an attomey representing DeLite Outdoor Advertising, Inc, whose Twin
Cities office is in Eagan, sent a letter dated May 21, 1998, to Council President Bostrom �
requesting that all spectal district sign plan applications be scheduled for public heazings
at the City Council. Although Pamela Wheelock is noted on the letter to receive a copy,
the copy has not been found at PED and, therefore, the objection was not o�cially
received by PED until June 4, 1994, when Larry Soderholm called Mr. Coyle to ask if he
intended to file any objections.
4. In the May 21 letter, Mr. Coyle complained that he was not receiving timely notice of
applications. In this complaint, he was correct. The PED staff originally working on
advertising signs was Roger Ryan, who retired in April with rivo weeks' notice. When
Larry Soderholm took over the assignment, there was a gap in notifications. Mr. Coyle
requested to be notified on Apri128, 1998. But no notifications were sent to him until
May 20, 1998, which notifications crossed in the mail with his letter to Council President
Bostrom. However, Peter Coyle's objection was still in time to affect 11 of the 13
applications. Even had notiFication been prompt, it would not have been in time for Mr.
Coyle to object to the appiication from the Highland Area Community Council (District
15), which was received on Apri12, 1998. Nor, most likely, would his objection have
been in time for the West Seventh/Fort Road Federation (District 9) application, which
was received on Apri16, 1998. Thus, the staff decided these two applications should not
be part of the Council's hearing. If the Council chooses, it may, of course, reopen the
applications from Districts 9 and 15 and consider them along with all the other
applications.
5. Since Mr. Coyle didn't have the district counciPs applications in hand at the time he

� wrote the May 21 letter of objection, he lacked specific information for detailing his
objection. He stated that DeLite Outdoor Advertising objected specifically to the
application from Dayton's Bluff (District 4) and to all the applications in general. He
requested that public hearings be held on all of them. In subsequent conversations, staff
understand the DeLite Outdoor Advertising's primary objection is that the applications
are overly broad. Unlike the previous sia districts, which cover a single commercial
area and deal with both business signs and advertising signs, the applications cover
entire citizen participation districts and focus just on billboards.
6. Objections to the special sign district applications have not been received from any of
the other outdoor advertising companies that operate in the city--Eller (formerly Naegle,
then Universal), Adams, or Midwest. The latter two companies aze also represented in
legal matters by Mr. Coyle.
Council File 97-1568 sets four standards for the Council review and approval of
applications by district councils for special sign districts:
A. The applications should be reasonable. As the staff understands the
negotiations leading to the adoption of this ordinance, an eazlier version of the
ordiaance contained a citywide moratorium on the construction and modification
of billboards during the legislative study period until new regulations could be
adopted. The final ordinance, instead of having a citywide moratorium,
provided for case by case moratoriums for citizen participation districts that
asked for one. If this background is correct, then the applications from district
� councils for billboard moratoriums are not only reasonable, they are exactly
what was anticipated. Although the letters submitted by the district councils are
short, they contain the information outlines in the ordinance, that is, boundaries
and the desired scope of the sia plan in general terms.
B. The apptications should not be over-inclusive. These new applications for
special sign district plans are unlike the previous special sign districts for Grand
Avenue, Smith Avenue, and Highland V illage. The three existing special sign
districts ban new billboards as a minor element of a plan in which the major
elements relate to the signs of the businesses operating on the street. The new,
proposed sign districts are geoa aphically broad, covering entire citizen
participation districts. But they are narrow in scope, addressing only advertising
signs. This is consistent with the intent of the ordinance a�d the legislative
study, which deals with advertising signs, not with business signs.
C. The proposed prohibitions should be reasonable and should not be
discriminatoty. The prohibitions against the construction or modification of
advertising signs are reasonable during the study period so that signs are not
built under today's regulations that could not be built under next year's revised
regulations. Once buiit, billboazds are seldom removed. The central cities of
Saint Paul and Minneapolis already have disproportionate shares of the
billboazds in the region because of loose regulation historically. The proposed
prohibitions do not discriminate among billboard companies. Many of the

proposals distinguish between billboards and advertising on bus benches and bus �
shelters, but the discussions of the legislative advisory committee concur that
this distinction is based on a genuine difference in kind.
D. The proposed prohibitions should further and assist the planning and
legislative process for the adopfion of special district sign plans.
Construction moratoriums are provided for in state law and are a common
feature of legislative studies to revise zoning regulations. Moratoriums allow for
calmer consideration of the pros and cons of proposed regulations because
decision makers aze not rushing to close the door on some particulaz unpopular
development. In this regard, the proposed prohibitions in the disirict councils'
letters are consistent with past practice in the city.
D. Staff Recommendation: PED and LIEP staff recommend approval of the special district
sign plan applications by aIl ofthe district councils. However, stafFrequests the City Council to
standardize the moratorium provisions for all the geographic areas where moratoriums aze
approved. Staff also requests the City Council to clarify that the moratoriums are interim
regulations that will be expire at such time as new regulations aze enacted by the City Council or
on December 31, 1999, whichever comes first.

I am writing to you on behalf of the District 2 Community Council to request a
Special Sign District Plan for ail of the District 2 area. It is my understanding that
this request will initiate a temporary moratorium on new advertising signs in District
2 until a Special Sign District Plan is adopted for District 2.
District 2 feels that this adveRising sign moratorium is especially needed as we are
just beginning a Small Area Plan for White Bear Avenue and the surrounding area.
As you know, the Small Area Plan Committee wili be looking into many different
issues, including land use, design and streetscape questions on White Bear Avenue.
It would be inappropriate for any major changes to take place on White Bear Avenue
before the Small Area Plan process is finished.
Thank you for this opportunity to insure that neighborhood concems can be taken
into account as the city addresses this issue.

1998 Land Use Committee meetin� and a resolution was passed addressing outdoor �
advertising. At our monthlti� Board meetin� on April 13, 1998, this, issue was discussed
again and the previous resolution received support from the entire council. It reads: The

(Larpenteur Avenue, interstate 35E, Burlingtan Northem Railroad tracks, Lexington
Parkway, Maryland Avenue, & Dale Street) be designated as a Special Sign District. �
We would also like to request a moratorium on advertising signs untii the City Council
decides whether new advertising sign regulations will be developed. This would include

WFIEREAS, the Council of the City of Saint Paul, in Council File 97-1568, as amended, —� –
adopted an interim ordinance prohibiting the establishment of new advertising signs and the
modification of eacisting advertising signs, pending the City's study of the need to establish
special dishict sign plans pursuant to Saint Paul Legislative Code § 66216; and
WHEREAS, Council File 97-1568 provided that applications for special district sign
plan applicarions may be initiated by filing an application with the director of the Department of
Planning and Economic Development; and
WHEREAS, Council File 97-1568 fiurther provided that only duly recognized
neighborhood district councils may apply for a special district sign plan; and
WFIEREAS, the following neighborhood district councils: 2, 3, 4, 5, 6, 9,10, 11, 12, 13
(Merriam Park and Snelling-Hamiine areas onty), 15 and 17, submitted applications far special
district sign plans pursuant to Councit File 97-15�8; and

WI3EREAS, Council File 47-1568 further provided that any objection to the filing of a
special sign district application must be written and would require a public hearing. The public
hearing would a11ow the Council to determine whether an application was reasonable, not over
inclusive, not discrisninatory, and would further assist the plamvng and legislative process
necessary for the adoption of special district sign plans for incorporation into the Saint Paul
Zoning Code; and
WFIEREAS, in a letter to Councilmember Dan Bostrom dated May 21, 1998, DeLite
Outdoor Advertising Inc. (DeLite) specifically objected to the special sign district application
from District 4 Community Council and generally objected to all other special sign district
applications. Delite requested that the matters be scheduled for public hearings; and
WHEREAS, pursuant to DeLite's request, the Council of the City of Saint Paul duly
scheduled a public hearing for July 8, 1998 with notice to affected parties; and
WHEREAS, on July 8. 1998, a public hearing on special sign district application as
provided pursuant to Council File 97-1568 was duly conducted by the City Council where all
interested parties were given an opportunity to be heazd; and

WHEREAS, the Council, having heard the statements made and having considered the
applications, the report of staff and the testimony produced during the public hearing,
DOES HEREBY RESOLVE:
That all the special district sign plan applications aze reasonable. Although each
application is geographically broad in that it encompasses the azea of the entire
district council boundary (except for the District 15 application that includes only
the boundaries of the Shepazd -Davem Forty Acre Study Area which is presently
underway) the applicarions aze nevertheless natrow in scope in that they address
only advertising signs which aze those signs located offpremises as opposed to
business signs which are on premise signs.
2. The prohibitions against the construcfion of new advertising signs or the
modification of existing advertising signs are also zeasonable in that the special
district sign plans aze designed to prevent construction of advertising signs under
today's regulations which might not be allowed if advertising sign regulations are
amended.
3. The prohibitions of these special district sign plan moratoriums are consistent.
The council finds that the prohibitions apply only to prohibit the construction of
new advertising signs or the modification of exiting advertising signs. It is
implicit that these prohibitions exclude bus shelter and bus bench advertising
devices as well public skyway advertising devices allowed under franchise
agreements pursuant to Saint Paul Legislarive Code Appendices I and J; and
4. Implementation of these special district sign plan moratoriums will fuither assist
the planning and legislative process.
BE IT FURTHER RESOLVED, that the interim regulations in effect by virtue of this
resolution and as required under Council File 97-1568 shall be deemed to expire at such tnne as
either new regulations are enacted by the council, or on December 31, 1999, whichever may
come first; and

general objections to the said applicafions by DeLite aze not supported; and
BE TT FINALLY RESOLVED, that a copy of this resolufion be delivered to the Saint

sign regulations, the Zoning Aduiinistrator and DeLite Outdoor Advertising, Inc.

Dear Ms. Anderson:
PED requests the City Council to schedule a public heazing on the objection by Delite Outdoor
Advertising to requests for billboard moratoriums and special sign districts by the citizen participation
districts listed above. PED requests that the public heazing be scheduled on July 8, 1998.
Council File 9-1568 provides that district councils may request moratoriusns on advertising signs during
the time that the Advertising Sign Legislative Advisory Committee is working. The moratoriums
become effective automatically after 30 days if no one objects to them. If someone objects, the Ciry
Councii is to hold a public hearing within 30 days of the objection to determine if the district councils'
requests are reasonable, nondiscriminatory, supportive of the planning process for advertising sign, and
are not overly broad. Delite Outdoor Advertising, Inc. sent the CiTy a letter stating that they think the
requests are overly broad.

Council File 97-1568 on advertising signs established a legislative advisory committee and
provided that district councils may apply for special district sign plans that impose interim
restrictions on signs untii the City Council decides whether to change city regulations goveming
advertising signs. Most advertising signs aze billboazds; a smaller number are bus benches and
bus shelters. The ordinance goes on to provide that district councils' applications for special
district sign plans become effective automatically after 30 days unless someone objects. If
someone objects, the City Council is to hold a hearing and decide whether the applications aze
reasonable and supportive of the legislative study process and are not over-inclusive or
discriminatory.
Staff recommends approval of the special sign district appiications and denial of the objection by
DeLite Outdoor Advertising, Inc.

A. Purpose: To consider the objection by DeLite Outdoor Advertising, Inc. to applications
for special district sign plans with moratoriums on billboard construction or modification by
District Councils 2,3,4,5,6,10,11,12,13 (Merriam Park and Snelling-Hamline), and 17, and to
decide by Council Resolution whether to approved these special district sign proposals.
B. Ordinance Citations:
Zoning Code, Sec. 66.216, provides for the creation of special district sign ptans that may set
tighter or looser sign regulations than the citywide regulations. Before 1998, three specia]
district sign plans were established for Grand Avenue, Smith Avenue, and Highland Village.
Council File 97-1568 is an interim ordinance that establishes a legislative advisory committee on
advertising signs and provides that special district sign plans can be created, upon application by
district councils, to preserve the status quo with respect to advertising signs during the ]egislative
study period. The applications by district councils become effective automatically afrer 30 days
unless someone objects. If someone objects, the City Council is to hold a public hearing and
decide whether to approve the special sign district applications. The following quotations are
from the ordinance:
"Applications. The term `application' shall mean and be limited to any written request by one or
more of the seventeen (17) district councils in the CiTy that the Council adopt a Special District
Sign Plan.... An application shall be in the form of a letter which describes the boundaries of the
area proposed for such a Sign Plan, and shall state in general terms the desired scope and
provisions ofsuch Sign Plan."(Lines 26-33)
"The term `objection' shall mean and include any written objection to such application." (Lines
34-35)

"Prohibitions effective on resolution. In the event of an objection, the prohibitions contained in �
this Section II will go into effect on the effective date of a Council resolution, adopted following
such public heazing, which resolution finds that such applicarion is reasonable and is not over-
inclusive, and that the said prohibitions are reasonable and not discriminatory and will further
and assist the planning and legislative process for the adoption of a Special District Sip Plan."

C. Findings:
I. Since Council File # 97-1568 was adopted on February 18, 1998, the Advertising Sign
Legislative Advisoty Committee has been appointed and has met regulazly since April.
Their goal is to complete recommendations by August 1, 1998 and present them to the
City Council. The Council will consider the recommendations and request review of
them by the Planning Commission. Then, it is likely that the City will adopt revised
regulations for adveRising sia s.
2. Between Apri12, 1998 and June 29, 1998, the City received 13 applications for special
sign districts from district councils. App(ica6ons are received by the City Council and
PED. As applications are received, PED notifies LIEP and other individuals who request
to be notified. Anyone may file an objection within 30 days, in which case the
application(s) goes to the City Council for a public hearing and decision.
3. Peter Coyle, an attomey representing DeLite Outdoor Advertising, Inc, whose Twin
Cities office is in Eagan, sent a letter dated May 21, 1998, to Council President Bostrom �
requesting that all spectal district sign plan applications be scheduled for public heazings
at the City Council. Although Pamela Wheelock is noted on the letter to receive a copy,
the copy has not been found at PED and, therefore, the objection was not o�cially
received by PED until June 4, 1994, when Larry Soderholm called Mr. Coyle to ask if he
intended to file any objections.
4. In the May 21 letter, Mr. Coyle complained that he was not receiving timely notice of
applications. In this complaint, he was correct. The PED staff originally working on
advertising signs was Roger Ryan, who retired in April with rivo weeks' notice. When
Larry Soderholm took over the assignment, there was a gap in notifications. Mr. Coyle
requested to be notified on Apri128, 1998. But no notifications were sent to him until
May 20, 1998, which notifications crossed in the mail with his letter to Council President
Bostrom. However, Peter Coyle's objection was still in time to affect 11 of the 13
applications. Even had notiFication been prompt, it would not have been in time for Mr.
Coyle to object to the appiication from the Highland Area Community Council (District
15), which was received on Apri12, 1998. Nor, most likely, would his objection have
been in time for the West Seventh/Fort Road Federation (District 9) application, which
was received on Apri16, 1998. Thus, the staff decided these two applications should not
be part of the Council's hearing. If the Council chooses, it may, of course, reopen the
applications from Districts 9 and 15 and consider them along with all the other
applications.
5. Since Mr. Coyle didn't have the district counciPs applications in hand at the time he

� wrote the May 21 letter of objection, he lacked specific information for detailing his
objection. He stated that DeLite Outdoor Advertising objected specifically to the
application from Dayton's Bluff (District 4) and to all the applications in general. He
requested that public hearings be held on all of them. In subsequent conversations, staff
understand the DeLite Outdoor Advertising's primary objection is that the applications
are overly broad. Unlike the previous sia districts, which cover a single commercial
area and deal with both business signs and advertising signs, the applications cover
entire citizen participation districts and focus just on billboards.
6. Objections to the special sign district applications have not been received from any of
the other outdoor advertising companies that operate in the city--Eller (formerly Naegle,
then Universal), Adams, or Midwest. The latter two companies aze also represented in
legal matters by Mr. Coyle.
Council File 97-1568 sets four standards for the Council review and approval of
applications by district councils for special sign districts:
A. The applications should be reasonable. As the staff understands the
negotiations leading to the adoption of this ordinance, an eazlier version of the
ordiaance contained a citywide moratorium on the construction and modification
of billboards during the legislative study period until new regulations could be
adopted. The final ordinance, instead of having a citywide moratorium,
provided for case by case moratoriums for citizen participation districts that
asked for one. If this background is correct, then the applications from district
� councils for billboard moratoriums are not only reasonable, they are exactly
what was anticipated. Although the letters submitted by the district councils are
short, they contain the information outlines in the ordinance, that is, boundaries
and the desired scope of the sia plan in general terms.
B. The apptications should not be over-inclusive. These new applications for
special sign district plans are unlike the previous special sign districts for Grand
Avenue, Smith Avenue, and Highland V illage. The three existing special sign
districts ban new billboards as a minor element of a plan in which the major
elements relate to the signs of the businesses operating on the street. The new,
proposed sign districts are geoa aphically broad, covering entire citizen
participation districts. But they are narrow in scope, addressing only advertising
signs. This is consistent with the intent of the ordinance a�d the legislative
study, which deals with advertising signs, not with business signs.
C. The proposed prohibitions should be reasonable and should not be
discriminatoty. The prohibitions against the construction or modification of
advertising signs are reasonable during the study period so that signs are not
built under today's regulations that could not be built under next year's revised
regulations. Once buiit, billboazds are seldom removed. The central cities of
Saint Paul and Minneapolis already have disproportionate shares of the
billboazds in the region because of loose regulation historically. The proposed
prohibitions do not discriminate among billboard companies. Many of the

proposals distinguish between billboards and advertising on bus benches and bus �
shelters, but the discussions of the legislative advisory committee concur that
this distinction is based on a genuine difference in kind.
D. The proposed prohibitions should further and assist the planning and
legislative process for the adopfion of special district sign plans.
Construction moratoriums are provided for in state law and are a common
feature of legislative studies to revise zoning regulations. Moratoriums allow for
calmer consideration of the pros and cons of proposed regulations because
decision makers aze not rushing to close the door on some particulaz unpopular
development. In this regard, the proposed prohibitions in the disirict councils'
letters are consistent with past practice in the city.
D. Staff Recommendation: PED and LIEP staff recommend approval of the special district
sign plan applications by aIl ofthe district councils. However, stafFrequests the City Council to
standardize the moratorium provisions for all the geographic areas where moratoriums aze
approved. Staff also requests the City Council to clarify that the moratoriums are interim
regulations that will be expire at such time as new regulations aze enacted by the City Council or
on December 31, 1999, whichever comes first.

this request will initiate a temporary moratorium on new advertising signs in District
2 until a Special Sign District Plan is adopted for District 2.
District 2 feels that this adveRising sign moratorium is especially needed as we are
just beginning a Small Area Plan for White Bear Avenue and the surrounding area.
As you know, the Small Area Plan Committee wili be looking into many different
issues, including land use, design and streetscape questions on White Bear Avenue.

before the Small Area Plan process is finished.

Community Council Board of Directors meeting, the Council unanimously
passed the following resolution regazding their request for a Special Sign
District:
The Merriam Park Community Council requests that a Special Sign
District be created for District 13M, whose boundaries are Summit
Ave. on the south, Snelling Ave. on the east, the Mississippi River and
city boundaries on the west, and University Ave. west to Cleveland
and south the RR tracks on the north. The Speciat Sign District
wvuld prohibit any additional billboards, modification of any existing
billboards, or replacement of any damaged billboards.

The Community Development Committee of the Higliland Area Community Council
passed the following resolution at the March committee meeting.
The Community Development Committee of the FIighland Area Community
Council requests that a special sign district be created in the azea of the Shep-
ard Davern 40 Acre Study.
The boundaries of the area are: beginning at a point where Shepard Road, Mississippi
River $oulevard and West �eventh intarsect, northeasterly along West Seventh Street to
Edgecumbe Road, north on Edgecumbe Road to St. Paut Avenue, east along St. Paul
Avenue to West Seventh Street, northeasterly along West Seventh Street to Homer Street,

WFIEREAS, the Council of the City of Saint Paul, in Council File 97-1568, as amended, —� –
adopted an interim ordinance prohibiting the establishment of new advertising signs and the
modification of eacisting advertising signs, pending the City's study of the need to establish
special dishict sign plans pursuant to Saint Paul Legislative Code § 66216; and
WHEREAS, Council File 97-1568 provided that applications for special district sign
plan applicarions may be initiated by filing an application with the director of the Department of
Planning and Economic Development; and
WHEREAS, Council File 97-1568 fiurther provided that only duly recognized
neighborhood district councils may apply for a special district sign plan; and
WFIEREAS, the following neighborhood district councils: 2, 3, 4, 5, 6, 9,10, 11, 12, 13
(Merriam Park and Snelling-Hamiine areas onty), 15 and 17, submitted applications far special
district sign plans pursuant to Councit File 97-15�8; and

WI3EREAS, Council File 47-1568 further provided that any objection to the filing of a
special sign district application must be written and would require a public hearing. The public
hearing would a11ow the Council to determine whether an application was reasonable, not over
inclusive, not discrisninatory, and would further assist the plamvng and legislative process
necessary for the adoption of special district sign plans for incorporation into the Saint Paul
Zoning Code; and
WFIEREAS, in a letter to Councilmember Dan Bostrom dated May 21, 1998, DeLite
Outdoor Advertising Inc. (DeLite) specifically objected to the special sign district application
from District 4 Community Council and generally objected to all other special sign district
applications. Delite requested that the matters be scheduled for public hearings; and
WHEREAS, pursuant to DeLite's request, the Council of the City of Saint Paul duly
scheduled a public hearing for July 8, 1998 with notice to affected parties; and
WHEREAS, on July 8. 1998, a public hearing on special sign district application as
provided pursuant to Council File 97-1568 was duly conducted by the City Council where all
interested parties were given an opportunity to be heazd; and

WHEREAS, the Council, having heard the statements made and having considered the
applications, the report of staff and the testimony produced during the public hearing,
DOES HEREBY RESOLVE:
That all the special district sign plan applications aze reasonable. Although each
application is geographically broad in that it encompasses the azea of the entire
district council boundary (except for the District 15 application that includes only
the boundaries of the Shepazd -Davem Forty Acre Study Area which is presently
underway) the applicarions aze nevertheless natrow in scope in that they address
only advertising signs which aze those signs located offpremises as opposed to
business signs which are on premise signs.
2. The prohibitions against the construcfion of new advertising signs or the
modification of existing advertising signs are also zeasonable in that the special
district sign plans aze designed to prevent construction of advertising signs under
today's regulations which might not be allowed if advertising sign regulations are
amended.
3. The prohibitions of these special district sign plan moratoriums are consistent.
The council finds that the prohibitions apply only to prohibit the construction of
new advertising signs or the modification of exiting advertising signs. It is
implicit that these prohibitions exclude bus shelter and bus bench advertising
devices as well public skyway advertising devices allowed under franchise
agreements pursuant to Saint Paul Legislarive Code Appendices I and J; and
4. Implementation of these special district sign plan moratoriums will fuither assist
the planning and legislative process.
BE IT FURTHER RESOLVED, that the interim regulations in effect by virtue of this
resolution and as required under Council File 97-1568 shall be deemed to expire at such tnne as
either new regulations are enacted by the council, or on December 31, 1999, whichever may
come first; and

BE IT FURTHER RESOLVED, that for the above-stated reasons, the specific and
general objections to the said applicafions by DeLite aze not supported; and
BE TT FINALLY RESOLVED, that a copy of this resolufion be delivered to the Saint
Paul Plauning Commission, the Legislative Advisory Committee reviewing cutrent advertising
sign regulations, the Zoning Aduiinistrator and DeLite Outdoor Advertising, Inc.

Dear Ms. Anderson:
PED requests the City Council to schedule a public heazing on the objection by Delite Outdoor
Advertising to requests for billboard moratoriums and special sign districts by the citizen participation
districts listed above. PED requests that the public heazing be scheduled on July 8, 1998.
Council File 9-1568 provides that district councils may request moratoriusns on advertising signs during
the time that the Advertising Sign Legislative Advisory Committee is working. The moratoriums
become effective automatically after 30 days if no one objects to them. If someone objects, the Ciry
Councii is to hold a public hearing within 30 days of the objection to determine if the district councils'
requests are reasonable, nondiscriminatory, supportive of the planning process for advertising sign, and
are not overly broad. Delite Outdoor Advertising, Inc. sent the CiTy a letter stating that they think the
requests are overly broad.

PURPOSE: To consider the objection of DeLite Outdoor Advertising to applications for Special
Sign Districts that include moratoriums on billboard construction and/or repair made by several
district councils pursuant to CF 97-1568, which was adopted on February 18, 1998.
Deaz Ms. Anderson:
Council File 97-1568 on advertising signs established a legislative advisory committee and
provided that district councils may apply for special district sign plans that impose interim
restrictions on signs untii the City Council decides whether to change city regulations goveming
advertising signs. Most advertising signs aze billboazds; a smaller number are bus benches and
bus shelters. The ordinance goes on to provide that district councils' applications for special
district sign plans become effective automatically after 30 days unless someone objects. If
someone objects, the City Council is to hold a hearing and decide whether the applications aze

A. Purpose: To consider the objection by DeLite Outdoor Advertising, Inc. to applications
for special district sign plans with moratoriums on billboard construction or modification by
District Councils 2,3,4,5,6,10,11,12,13 (Merriam Park and Snelling-Hamline), and 17, and to
decide by Council Resolution whether to approved these special district sign proposals.
B. Ordinance Citations:
Zoning Code, Sec. 66.216, provides for the creation of special district sign ptans that may set
tighter or looser sign regulations than the citywide regulations. Before 1998, three specia]
district sign plans were established for Grand Avenue, Smith Avenue, and Highland Village.
Council File 97-1568 is an interim ordinance that establishes a legislative advisory committee on
advertising signs and provides that special district sign plans can be created, upon application by
district councils, to preserve the status quo with respect to advertising signs during the ]egislative
study period. The applications by district councils become effective automatically afrer 30 days
unless someone objects. If someone objects, the City Council is to hold a public hearing and
decide whether to approve the special sign district applications. The following quotations are
from the ordinance:
"Applications. The term `application' shall mean and be limited to any written request by one or
more of the seventeen (17) district councils in the CiTy that the Council adopt a Special District
Sign Plan.... An application shall be in the form of a letter which describes the boundaries of the
area proposed for such a Sign Plan, and shall state in general terms the desired scope and
provisions ofsuch Sign Plan."(Lines 26-33)
"The term `objection' shall mean and include any written objection to such application." (Lines
34-35)

"Prohibitions effective on resolution. In the event of an objection, the prohibitions contained in �
this Section II will go into effect on the effective date of a Council resolution, adopted following
such public heazing, which resolution finds that such applicarion is reasonable and is not over-
inclusive, and that the said prohibitions are reasonable and not discriminatory and will further
and assist the planning and legislative process for the adoption of a Special District Sip Plan."

C. Findings:
I. Since Council File # 97-1568 was adopted on February 18, 1998, the Advertising Sign
Legislative Advisoty Committee has been appointed and has met regulazly since April.
Their goal is to complete recommendations by August 1, 1998 and present them to the
City Council. The Council will consider the recommendations and request review of
them by the Planning Commission. Then, it is likely that the City will adopt revised
regulations for adveRising sia s.
2. Between Apri12, 1998 and June 29, 1998, the City received 13 applications for special
sign districts from district councils. App(ica6ons are received by the City Council and
PED. As applications are received, PED notifies LIEP and other individuals who request
to be notified. Anyone may file an objection within 30 days, in which case the
application(s) goes to the City Council for a public hearing and decision.
3. Peter Coyle, an attomey representing DeLite Outdoor Advertising, Inc, whose Twin
Cities office is in Eagan, sent a letter dated May 21, 1998, to Council President Bostrom �
requesting that all spectal district sign plan applications be scheduled for public heazings
at the City Council. Although Pamela Wheelock is noted on the letter to receive a copy,
the copy has not been found at PED and, therefore, the objection was not o�cially
received by PED until June 4, 1994, when Larry Soderholm called Mr. Coyle to ask if he
intended to file any objections.
4. In the May 21 letter, Mr. Coyle complained that he was not receiving timely notice of
applications. In this complaint, he was correct. The PED staff originally working on
advertising signs was Roger Ryan, who retired in April with rivo weeks' notice. When
Larry Soderholm took over the assignment, there was a gap in notifications. Mr. Coyle
requested to be notified on Apri128, 1998. But no notifications were sent to him until
May 20, 1998, which notifications crossed in the mail with his letter to Council President
Bostrom. However, Peter Coyle's objection was still in time to affect 11 of the 13
applications. Even had notiFication been prompt, it would not have been in time for Mr.
Coyle to object to the appiication from the Highland Area Community Council (District
15), which was received on Apri12, 1998. Nor, most likely, would his objection have
been in time for the West Seventh/Fort Road Federation (District 9) application, which
was received on Apri16, 1998. Thus, the staff decided these two applications should not
be part of the Council's hearing. If the Council chooses, it may, of course, reopen the
applications from Districts 9 and 15 and consider them along with all the other
applications.
5. Since Mr. Coyle didn't have the district counciPs applications in hand at the time he

� wrote the May 21 letter of objection, he lacked specific information for detailing his
objection. He stated that DeLite Outdoor Advertising objected specifically to the
application from Dayton's Bluff (District 4) and to all the applications in general. He
requested that public hearings be held on all of them. In subsequent conversations, staff
understand the DeLite Outdoor Advertising's primary objection is that the applications
are overly broad. Unlike the previous sia districts, which cover a single commercial
area and deal with both business signs and advertising signs, the applications cover
entire citizen participation districts and focus just on billboards.
6. Objections to the special sign district applications have not been received from any of
the other outdoor advertising companies that operate in the city--Eller (formerly Naegle,
then Universal), Adams, or Midwest. The latter two companies aze also represented in
legal matters by Mr. Coyle.
Council File 97-1568 sets four standards for the Council review and approval of
applications by district councils for special sign districts:
A. The applications should be reasonable. As the staff understands the
negotiations leading to the adoption of this ordinance, an eazlier version of the
ordiaance contained a citywide moratorium on the construction and modification
of billboards during the legislative study period until new regulations could be
adopted. The final ordinance, instead of having a citywide moratorium,
provided for case by case moratoriums for citizen participation districts that
asked for one. If this background is correct, then the applications from district
� councils for billboard moratoriums are not only reasonable, they are exactly
what was anticipated. Although the letters submitted by the district councils are
short, they contain the information outlines in the ordinance, that is, boundaries
and the desired scope of the sia plan in general terms.
B. The apptications should not be over-inclusive. These new applications for
special sign district plans are unlike the previous special sign districts for Grand
Avenue, Smith Avenue, and Highland V illage. The three existing special sign
districts ban new billboards as a minor element of a plan in which the major
elements relate to the signs of the businesses operating on the street. The new,
proposed sign districts are geoa aphically broad, covering entire citizen
participation districts. But they are narrow in scope, addressing only advertising
signs. This is consistent with the intent of the ordinance a�d the legislative
study, which deals with advertising signs, not with business signs.
C. The proposed prohibitions should be reasonable and should not be
discriminatoty. The prohibitions against the construction or modification of
advertising signs are reasonable during the study period so that signs are not
built under today's regulations that could not be built under next year's revised
regulations. Once buiit, billboazds are seldom removed. The central cities of
Saint Paul and Minneapolis already have disproportionate shares of the
billboazds in the region because of loose regulation historically. The proposed
prohibitions do not discriminate among billboard companies. Many of the

proposals distinguish between billboards and advertising on bus benches and bus �
shelters, but the discussions of the legislative advisory committee concur that
this distinction is based on a genuine difference in kind.
D. The proposed prohibitions should further and assist the planning and
legislative process for the adopfion of special district sign plans.
Construction moratoriums are provided for in state law and are a common
feature of legislative studies to revise zoning regulations. Moratoriums allow for
calmer consideration of the pros and cons of proposed regulations because
decision makers aze not rushing to close the door on some particulaz unpopular
development. In this regard, the proposed prohibitions in the disirict councils'
letters are consistent with past practice in the city.
D. Staff Recommendation: PED and LIEP staff recommend approval of the special district
sign plan applications by aIl ofthe district councils. However, stafFrequests the City Council to
standardize the moratorium provisions for all the geographic areas where moratoriums aze
approved. Staff also requests the City Council to clarify that the moratoriums are interim
regulations that will be expire at such time as new regulations aze enacted by the City Council or
on December 31, 1999, whichever comes first.

Community Council Board of Directors meeting, the Council unanimously
passed the following resolution regazding their request for a Special Sign
District:
The Merriam Park Community Council requests that a Special Sign
District be created for District 13M, whose boundaries are Summit
Ave. on the south, Snelling Ave. on the east, the Mississippi River and
city boundaries on the west, and University Ave. west to Cleveland
and south the RR tracks on the north. The Speciat Sign District
wvuld prohibit any additional billboards, modification of any existing
billboards, or replacement of any damaged billboards.

The Community Development Committee of the Higliland Area Community Council
passed the following resolution at the March committee meeting.
The Community Development Committee of the FIighland Area Community
Council requests that a special sign district be created in the azea of the Shep-
ard Davern 40 Acre Study.
The boundaries of the area are: beginning at a point where Shepard Road, Mississippi
River $oulevard and West �eventh intarsect, northeasterly along West Seventh Street to
Edgecumbe Road, north on Edgecumbe Road to St. Paut Avenue, east along St. Paul
Avenue to West Seventh Street, northeasterly along West Seventh Street to Homer Street,
southeasteriy along Homer Street to Shepard Road, southwesterly along Shepard to the
