January 20, 1998

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 1:30 p.m.
1336 Hewitt Avenue
Mike Schmid, owner, appeazed and stated the building is being condemned because of the sofFits
and the siding. Mr. Schmidt had with him today invoices for both. The downstairs is vacant
because it is being worked on. The contractor that is going to take caze of the problem is
currently ill, but said he will be abie to start in 30 days. Mr. Schmid also had an invoice for the
windows. The inside of the building is almost done. There aze new floors and light fixtures. It
has all been painted. Mr. Schmidt plans to stay at the duplex himself.
Gerry Strathman asked was the properiy condemned. Mr. Schmid responded yes but was told
this appeal puts eveiything on hold. Also, he had no place to go.
Jim Prill, Public Health, reported there is an extensive history back to April of 1996. There have
been essentially no repairs to the buildings since that time. Mr. Schmid has been issued 7 tickets
with multiple charges. The building was condemned in October of 1996 because the owner did
not complete the repairs in a timely manner. That condemnation was later lifted. The main
problem and the reason far this condemnation is the exterior of the building. Mr. Prill looked at
the property today and there seems to be additional problems. Sometimes there is gazbage in the
yard like there was today. The public sidewalk has not been cleared and looks as if it has not
been cleared a11 season. Also today, there is a problem with inadequate refuse containers,
garbage and refuse bags on the ground, and furniture. This was a problem a month ago and at
that time, Public Health issued a stunmary abatement order for garbage.
Gerry Sirathman asked if interior violations have been resolved. Mr. Prill responded there were
some violations in Unit 1, which the owner now occupies. When the previous tenant moved out,
Mr. Prill was unable to get back into the building so it is ucilaiown if the violations have been
conected. Mr. Strathxnan asked about the ceilings in Unit #2. Mr. Prill responded he had not
been in the second unit. Mr. Strathman asked about the gazage and safety issues. Mr. Prill
responded the door on the gazage might have been repaired, but the siding and paint damage still
exist. As for safety, the soffits may be falling off and there is dilapidation of the building.
Mike Schmid stated he instantly called a company to clean up the garbage in the yard. Two days
later, there was one bag of trash laying next to the container. Someone complained, and it was
cleaned up. Mr. Schmid stated he will make sure the yazd is kept clean.

Gerzy Strathman asked about the windows. Mike Schmid stated he will do it himself and it will
take 30 days to install them. If he could have an eatension of 90 days, the house will look better.
Gerry Strathman laid over this item to Apri17, 1998, to aliow Mike Shmid time to make repairs.
Mr. Strathmau requested a report from Public Health on that day regarding all the violations. If
there aze still outstanding issues, the manner will be discussed at that time.
2164 Lower Saint Dennis Road
John and Susan Mollner appeared. Mr. Mollner stated the house was purchased a year ago.
There were two rainleaders that were connected. The realtor told the Mollners they were hooked
up properly to the storm sewers. The Rainleader Department told the Mollners that everything
was taken caze of and not to worry about it. Shortly after buying the house, the Mollners
received tags. They applied for an extension. They talked to several contractors and all thought
there was a problem with safety and shedding water. There is not enough room between the
house and the walkway to handle that much water. Susan Mollner stated a building inspector
came out and told them there was no way to do it. There will be ice on the driveway or a person
has to step over the rainleaders. Both are safety issues. There was a variance on the house when
purchased and the Mollners would like it to be continued.
Pat Cahanes, Public Works, reported the Mollners were sent in 7uly a new owner letter. This
letter had a request for time extension to send to Public Works or the owners had a month to
disconnect the rainleaders. Mr. Cahanes inspected the property on October 8, 1997. Mr.
Cahanes' spoke to the Mollners on October 9 and October 17 explaining Public Works would
need a letter for an extenfion of time. After October 27, 1997 Mr. Cahanes sent out a letter
denying extension because he did not receive a request.
Gerry Strathman asked about options. Pat Canahes staxed attaching it to the storm sewer would
be expensive. The situation is not unlike some houses in Saint Paul where the down spout
crosses a sidewalk or discharges onto a dziveway. The driveway down spout could be rerouted.
John Mollner stated it is illegal to have water shedding into your neighbor's yazd.
Gerry Strathman stated this ordinance was passed ten yeazs ago. Saint Paul was under federal
suit in respect to pollution of the Mississippi River. Vaziances are not allowed because the
rainleader program agreement between Saint Paul and the federal government did not provide for
variances. Mr. Strathman has not heard of any exceptions to this ordinance.
Gerry Strathman asked how did the Mollners pzopose to solve this problem. Susan Mollner
responded nothing can be done until spring. Pat Cahanes gave some suggestions which 3nclude
having a down spout crossing a sidewaik, saying this is not unusual in Saint Paul.
Gerry Strathman gave an extension of July 20, 1998 to disconnect the rainleaders.
The meeting was adjourned at 2:04 pm.
