demolition, or otherwise nonexistence of the
encroaching building, the vacated land shall
revert to the City of Saint Paul as street
right-of-way without cost or charges to the
city.
4. That a permanent utility easement be retained ,
within the vacated area, to protect the interests
of Northern States Power Company.
5. That the petitioners , their heirs , and assigns ,
by acceptance of the terms and conditions of
this vacation, agree to indemnify, defend, and
save harmless the City of Saint Paul , its
, officers , and employees from all suits ,
actions , or claims of any character brought as
a result of injuries or damages received or
sustained by any person, persons , or property
on account of this vacation, or petitioner' s
use of this property, including but not
limited to a claim brought because of any act
of omission, neglect or misconduct of said
petitioner or because of any claims or
liability arising from any violation of any
law or regulation made in accordance with the
law whether by the petitioner of any of its
agents or employees.

RESOLV D, that upon the petition of Jamea D. and Anne NI.
Carlson, e�t al, per Finance Department File No. 17-1g8g, that
part of the alley in Block 3 , Highview Adflition, bounded b�
Beechwood, Saunders , and Howell, hereinafter described, be and
the same is hereby vacated and discontinued as public property.
The vacated area is described as follows :
That part of the alley ac�jacent to Lot 18, Block
3, Highview Addition, St. Paul, Minnesota which
l�ies north of the westerly eztension of the moat
sputherly line of said lot 18 and which lies east
oJf the southerly eztension of the most weaterly
l�ne of said lot 18; egcept the followin�:
All that part of said alley in $aid Block 3 ,
lying south of a line 5 feet north of and
parallel to the moat southerly line (egtended
westerly) of said I,ot 18.
This vacation shall be subject to the following
conditions:
1. That this vacation shall be subject to all the
terms and conditions of Chapter 130, codified
March 1, 1981 , of the Saint Paul Legislative Code ,
as amended. their
2 . That the petitioners , ���e/�heirs , and assigns
shall pay the city $500•00 as compensation for
this vacation which is due and payable within
60 days of the publication date of thia
resolution.
3 . That the land described above is being vacated
to accommodate a building encroachment and
that upon removal , reconstruction, alteration,
