RESOLVED, that the Council of the City of Saint t�aul hereby
requests the Saint Paul Charter Commission to review and recommend
for unanimous Council adoption, pursuant to Minnesota Statutes
Section 410. 12 , Subd. 7 , the attached amendment to the Saint
Paul City Charter; and, be it
FINALLY RESOLVED, that the City Clerk is hereby directed
to transmit a copy of this Resolution with the attached ordinance
to the secretary of the Saint Paul Charter Commission.

An ordinance amending Section 12. 12 .4 of the
Charter of the City of Saint Paul pertaining
to the tenure of police chief, fire chief,
and personnel director.
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That pursuant to Minnesota Statutes Section 410. 12, Subd. 7,
and upon recommendation of the Charter Commission of the City of
Saint paul, Section 12. 12.4 of the Charter of the City of Saint
Paul be and the same hereby is repealed, and substituted in lieu
and in place thereof is a new Section 12. 12.4 which shall read as
follows:
"Sec. 12. 12.4. Tenure of police chief, fire chief,
and personnel director. The term of appointment for the
police chief, for the fire chief, and for the personnel
director shall be six (6) years each and until each one' s
successor is appointed and qualifies.
During the first year of a term, a police chief,
fire chief or personnel director may be removed, with or
without cause, by the mayor upon written notification to
the appointee and approval by the council. After the
first year of a term, the mayor may, upon written
notification to the appointee and the city council,
remove the appointee, for cause only, with the approval
of at least five (5) members of the council. Pending the
hearing, the appointee may be suspended with or without
pay by the Mayor.
Ninety (90) days prior to the expiration of a term,
the incumbent shall submit to the mayor a letter of
intent which shall state whether the incumbent requests
reappointment and a management report whose contents
shall be established by administrative order.
Thirty (30) days prior to expiration of a term, the
mayor shall submit to�he city council a letter which
states whether the incumbent is to be reappointed. The
term of an incumbent, whom the mayor intends to
reappoint, shall continue until the city council approves
or declines to approve the reappointment.

Expiration of a term prior to or without a
nomination for reappointment by the mayor shall result
in a vacancy. In either of these instances or in any
other vacancy, the committee provided for herein shall
arrange for an examination and the mayor shall appoint
an acting police chief, fire chief or personnel
director. "
Section 2 .
This ordinance shall take effect and be in force ninety (90)
days from and after its passage, approval and publication.

Dear Mr. Faricy and Charter Commission Members:
In reviewing Council File 90-61 which requests the City Charter Commission
to review an ordinance amending Section 12.12.4 of the City Charter, the City
Council is taking no formal stance regarding this resolution and request.
For your information, this Council Resolution was discussed at the May 6,1990
City Council Finance Committee. At that time, there was much discussion. The
Finance Committee determined that no consensus will be reached by the Council
in deciding this issue. Additionally, the Committee decided that no partial
decision could be approved. It should be noted that this discussion does not
preclude any future action. However, the City Council has no formal
recommendation at this time.
Therefore, the Finance Committee is recommending that this resolution be laid
over indefinitely.

Subject: Charter Amendment to Section 12 . 12 .4
Dear Council President Scheibel and Members of the Council:
Enclosed for your review please find a resolution requesting
Charter Commission review of an ordinance amending Section 12 . 12 .4
of the City Charter pertaining to the tenure of the police chief,
fire chief and personnel director.
I have reviewed and considered the Five Year Master Plan for the
fire department and have spent some time thinking about the recent
events connected with that department. I believe that good
government and good management practices are neither served nor
promoted by a law which sets a term for a senior manager and
creates the presumption of reappointment unless affirmative steps
are taken.
This presumption of reappointment creates a situation in which the
Mayor " . . . not more than ninety (90) nor less than sixty (60) days
before the end of an incumbent's term . . . " must act if he wishes
not to reappoint. If, during this thirty day window, the Mayor
does not take affirmative steps to terminate the incumbent,
effective at the end of the current term, then the Mayor must
proceed with reappointment. I believe that senior managers, like
the police chief, fire chief, and personnel director should be
appointed by acts of commission rather than omission.
The proposed Section 12 . 12 . 4 of the Charter retains the six year
term, eliminates the presumption of reappointment, and requires the
incumbent to affirmatively seek reappointment and to submit a
management report.
