That the Saint Paul Administrative Code is he�r`eby amended by
adding a new chapter to read as €.ollows:
Section 67 .011. Definitions.
For the purposes of this chapter the tezfns herein shall have
the meaning ascribed to them as follaw�`:
(a) P�destrian skyway system means ;�any system of providing
fpr pe estrian tra ic circ�ilation, mechanical or
otherwise elevated above grou�id, within and without the
pwblic rights�of�way, and ;:'through or above private
property and buildings , .. and includes overpasses,
bridges, passageways, walkways, concourses, .. hallways,
corridors, arcades, cour,ts, plazas , malls, e�l.evators,
escalators , heated canopies and access �.}�d all
fixtures, furniture, signs, equipment, facil'`�ties,
s�rvices and appurteq�ances. The term shall in��.ude

systems or portions of systems which are built in the
future. A pedestrian skyway system shall include
stairways and escalators leading from or into the
skyway system from private buildings and areas under
stairs and escalators leading to and connecting
concourse corridors to public streets or other public
property.
(b) 0peration and/or Maintenance means all services
ren ere or contracted for by the City in the day-to=
day operation or maintenance of a security system for
the Pedestrian Skyway System including, but not limited
to, such services as management fees, equipment repair
and replacement, a central station monitoring system,
communications and personnel .
(c) Service charges means the costs and expenses to be
incurred or incurred by the city in the operation and
maintenance of any security system for the pedestrian
skyway system , which costs and expenses may be
collected against benefited property in a manner and
amounts as determined by the city and as provided
herein.
Section 67. 02 . Council powers.
(a) The council of the City of Saint Paul, having the po wer
to operate and maintain a pedestrian skyway system as
defined in Section 66.0�1 (1) , may charge and collect all
or part of the service charges incurred pursuant to
this chapter .

(b) The council each year shall estimate the services and
the costs necessary to operate and maintain a security
system for the pedestrian skyway system under this
chapter and the charges to be levied against benefited
property as provided herein. After these estimates
have been made the city council shall fix a date for
public hearing , and the city clerk shall cause to be
published notice of such hearing in a legal newspaper
at least twice no less than one week prior to such
public hearing. Not less than ten (1�) days before the
hearing, notice thereof shall also be mailed to the
owner of each parcel within the area proposed to be
charged, but failure to give mailed notice or any
defects in the notice shall not invalidate the
proceedings. For the purpose of giving mailed notice,
owners shall be those shown to be such on the records
of the county auditor or county tax statem ents, but
other appropriate records may be used for this
purpose. The notice shall state the date, time and
place of such hearing, the particular services to be
performed, and the estimate of the costs and expenses
of such services to be charged against benefited
property.
(c) At such hearing the council shall hear property owners
with reference to the scope and desirability of the
proposed services and the method of collection for such
services.
Sec. 67. 03 . Procedure for collection of service charges.
Any annual service charge levied or imposed under this
chapter shall be placed or distributed against the properties
benefited by or which received or which is deemed to have
received the service. The apportionment of the amounts to be
charged shall be a reasonable allocation of the costs of the

services. ���,he service charge shall payable in one � single
installment bi�, collected in two (2) ayments in the same manner
as real prope��ty taxes ; and ��iall be payable when due
notwithstanding an�,,,appeal as pzbvided in Section 66.05, except
that in the event an�'��ppealing ;.�arty is successful on appeal the
city shall reimburse t� appe,�ling party by the amount reduced or
eliminated. With these4e,x'ceptions, service charges shall be
collected using the proce�,res set forth in Minnesota Statutes,
Sections 429.061 and ��29.0'1� and shall be remitted in their
entirety, including an� interes�t�, directly to the city.
Sec. 67. 04. l�ppeal to distric� court.
Any property owner aggrieved by t-h_e city' s adoption of the
service charge%assPSSment roll may appeal�., to the district court
in the mann�"r set forth in Chapter 14 of' the Saint Paul City
Charter.
Sec.�ion 67 . 415. Severability.
If any one or more of the provisions of this 4c�iapter are
deen�-�d unlawful for any reason, all other provisions ��,ontained
her�in nevertheless shall remain in full force and effect.

This ordinance shall be effective and be in force 30 days
from its passage, approval and publication.
