This property is legally described as follows, to wit: Lot 14, Chute Brothers Division No. 5 Addition to ffie City of St. Paul, Minn. WHEREAS, based upon the records in the Ramsey County Recorder's Office and information obtained by Public Health on or before September 29, 1997, the following are the now known interested or responsible parties for the Subject Properiy: David Thompson, 2415 Bryant Avenue South, Mpls., MN 554Q5-2928; Luong Van Nguyen, 734 L.afond Avenue, St. Paul, MN SS1Q4-1603; Randy Radunz, P.O. Box 6543, St. Paul, MN 55106 WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the Saint Paul I.egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated October 16, 1997; and WAEREAS, this order informed the then known interested or responsible parties that the structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and WHEREAS, this order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Property by November 17, 1997; and WHEREAS, the enforcement officer has: posted a placard on the Subject Property declaring this building(s) to constitute a nuisance condition; subject to demolition; and WFiEREAS, this nuisance condition has not been corrected and Public Health requested that the City Clerk schedule public hearings before the L.egislative Aearing Officer of the City Council and the Saint Paul City Council; and WHEREAS, the interested and responsible parties have been served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City Council on Tuesday, January 20, 1998 to heaz testimony and evidence, and after receiving testnnony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Properry safe and not detrimental to the public peace, heaith, safety and welfare and remove its blighting influence on the communiry by rehabilitating this structure in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to be completed within fifteen (15) days after the date of the Councii Hearing; and oRi��NA� �r -� �- WFIEREAS, a hearing was held befare the Saint Paul City Council on Wednesday, January 28, 1998 and the testimony and evidence including the action taken by the Legislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 734 L,afond Avenue (rear}; 1. That the Subject Propeny comprises a nuisance condition as defined in Saint Paui I.egislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estirnated to exceed three thousand dollars ($3,000,00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Properry. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). S. That the deficiencies causing this nuisance condition have not been corrected. 6. That Public Health has posted a placard on the Subject Property which deciares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the Vacant/Nuisance Buildings Code Enforcement Program. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. •�_�_• The Saint Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safety and welfare and remove its blighUng influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. If the above corrective action is not completed within this period of time the Public Health, Code Enforcement Prograzn is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the S�bject Properry pursuant to the provisions of Chapter 45 of the Saint Paul I.egislative Code. 3. In the event the building is to be demolished and removed by the City of Saint Paul, a11 personal properry or fixtures of any kind which interfere with the demolition and removal shall be removed from the property by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such properry as provided by law. 4. It is further ordered, that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislauve Code. The Legislative Hearing Officer recommends approval of the 15 day order to remove or repair the building. �1$ 2- MINUTES OF LEGISLATIVE HEARING 7anuary 20,1998 Room 330, City Hall Gerry Strathman, Legislative Hearing Officer STAFF PRESENT: Chuck Votel, Public Health Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:01 a.m. 237 Page Street East Chuck Votel reported that he had spoken to the owner James Lorenz who said that he intended to rehabilitate the property. The Council had previously approved a layover. The owner had to post a bond and pay the fees, neither of which have been done. James Lorenz appeared and stated he hopes to close on the property tomorrow. The indoor rehabilitazion wili be done in ten weeks. The gazage and exterior will begin when weather permits. Gerry Strathxnan asked James Lorenz was he prepazed to post a bond. Mr. Larenz responded that he would. Geiry Strathman recommended 6 months to complete the rehabilitation on condition that a $2,000 bond is posted by noon of January 28, 1998. 734 Lafond Avenue rearj Chuck Votel reported that only the reaz house is the issue here. It was condemned in April of 1996. There have been three summary abatement notices. Vacant building fees and 1997 real estate taxes aze unpaid. The estimated cost to repair is $3,000. The cost to demolish is $5,330. Randy Radunz, owner, appeared and stated he has owned the property for approximately 3 months. The house is structurally obsolete and should be tom down. He would like to salvage as much as possible and demolish the house himself. Mr. Radunz asked for 90 days to tear the house down. Chuck Votel stated it is pernussible for the owner to do that with tlie proper permits, but suggested vacant building fees be paid. Gerry Strathman asked was the building secure. Mr. Radunz stated it would be difficult to get into the building. Gerry Strathman recommended amending the order to 3 months to remove or repair the building if the vacant building fee is paid by noon of January 28, 1998. ar-�2- Minutes of 1/20/98 Legislative Hearing 1478 Edmund Avenue Page 2 - — Chuck uotel reported ihe buiiding has been vacant since July of 1996. The current property owner is Michael DeGidio who called Mr. Votel this morning and said all the work is done and is ready for a code compliance re-inspection. However, records show no pernuts have been taken out yet for the electdcal work. Mr. DeGidio stated he hired an electrical company to do the work. If the work is done, it may be substandard. Also, a bond has not been posted. The code compliance report is not extensive; the owner does not have much work to do. Real estaie t�es and vacant building fees aze unpaid. Beth Randall, 1558 W. Minnehaha, appeared and stated the building has not been occupied. The ongoing concem is that there should not be long term vacant buildings in this neighborhood because this can lead to nuisance conditions. The owner owes $3,400 on his mortgage and foreclosure process is about to be started. Gerry Strathman recommended approval of the 15 day order to remove or repair the building 844 Galtier Street No one appeared. Chuck Votel reported Housing and Urban Development (HUD) obtained the building in September of 1997. There have been four summary abatement notices. The Code Enforcement Inspectors esrimate the cost to repair this structure if $35,000. HUD has not conveyed their intentions.
