1 BE IT RESOLVED, that, upon the peUtion of Housing Redevelopment Authority, as documented in
2 Finance Department File Number 5-1998, public properties hereinafter described are hereby vacated and
3 discontinued as public property: and, subject to the herein stated exceptions, the easements within those
4 public properties are hereby released.

8 that part of the northerly 10.00 feet of Lots 1, 2, 3 and 4, Block 14, all in Rice and Irvine's
9 Addition to St. Paul, according to the recorded plat thereof, Ramsey County, Minnesota, lying
10 westerly of the easterly 10.00 feet of said Lot 1 and easterly of a line described as commencing at
11 the northeast corner of said Lot 4, being a point on the southerly line of I,ot 1, Block 4, St. Paul
12 Companies Plat No. l, according to the recorded plat thereof, Ramsey County, Minnesota; thence
13 westerly along said southerly line of said Lot 1, Block 4, a distance of 17.89 feet to the most

westerly comer of said L,ot 1, Block 4, said point being the point of beginning of the line to be
described; thence southwesterly deflecting to the left 56 degrees 49 minutes 31 seconds a
distance of 11.95 feet to the southerly line of said northeriy 10.00 feet of Lot 4; and said line

19 This vacation shall be subject to the terms and condition of Chapter 130, codified March 1, 1981, of the
20 Saint Paul Legislative Code as amended, and to the following conditions:

That the petitioner's, their successors and assigns shall pay $500.00 as an administraUVe fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of District Energy St. Paul, Incorporated.
28 3. That, with the accompanying Utility Easement Certificates of Intended Non-Use, filed
29 voluntazily on behalf of U.S. West Communications, Incorporated, Northern States Power
30 Company, MCI Metro, Continental Cablevision, The Water Utility, and The Department of
31 Public Works, made a part hereof by this reference and filed in the office of the City Clerk of
32 Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the
33 right to the utility easements in the vacated area described above.

1 4. That the petitioners, their successors and assib s agree to indemnify, defend and save harmless
2 the City of Saint Paul, its officers and employees from all suits, actions or claims of any chazacter
3 brought as a result of injuries or damages received or sustained by any person, persons or
4 property on account of this vacation or petitioners' use of this property, including but not limited
5 to, a claim brought because of any act of omission, neglect, or misconduct of said petiuoners or
6 because of any claims or liability arising from any violation of any law or regulation made in
7 accordance with the law, whether by the petitioners or any of their agents or employees.
9 5. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
10 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution
11 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
12 al] respects with these terms and conditions.

this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained within the vacated area to protect the interest

28 3. That, with the accompanying Utility Easement Certificates of Intended Non-Use, filed
29 voluntazily on behalf of U.S. West Communications, Incorporated, Northern States Power
30 Company, MCI Metro, Continental Cablevision, The Water Utility, and The Department of
31 Public Works, made a part hereof by this reference and filed in the office of the City Clerk of
32 Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the
33 right to the utility easements in the vacated area described above.

28 3. That, with the accompanying Utility Easement Certificates of Intended Non-Use, filed
29 voluntazily on behalf of U.S. West Communications, Incorporated, Northern States Power
30 Company, MCI Metro, Continental Cablevision, The Water Utility, and The Department of
31 Public Works, made a part hereof by this reference and filed in the office of the City Clerk of
32 Saint Paul, the City, for itself and on behalf of these corporations and departments, waives the
33 right to the utility easements in the vacated area described above.
