WHEREAS, §293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a finding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, Riverfeast, represented by Ron Maddox, Genex'al
Manager, who has been designated as the responsible person on the
application, has applied for a variance to allow live music at
Kellogg Park and the Wabasha Bridge, on August 14, 15 and 16,
1998; and
WHEREAS, applicant is seeking a variance for the hours of
11:30 a.m, to 10:30 p.m. on all three dates; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the live music; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to Riverfeast, subject to the following
conditions:
1) The variance shall be for the hours of 11:30
a.m to 10:30 p.m. on August 14, 15 and 16,
1998.
2) A11 electronically powered equipment used in
conjunction with the event shall not exceed
idd �9-dBA as measured at the closer of the sound
mix or at a distance of 100 feet from the
front of the stage.

3) The applicant shall provide personnel and
equipment who shall provide continuous sound
level monitoring between 11:30 a.m. and 10:30
p.m. on all dates to ensure compliance with
Condition #2.
4) All electronically powered equipment, PA

shall be turned off no later than 10:30 p.m.
on all three dates.

FURTHER RESOLVED, that any violation of the conditions set
forth above during the August 14, 1998 date may result in
revocation of the grant of a variance for the August 15 and 16,
1998 dates, and any violation of the conditions set forth above
during the August 15, 1998 date may also result in revocation of
the grant of a variance for the August 16, 1998 date, in addition
to any criminal citation which might issue.

RiverFeast to allow two sound stages, one at Kellogg Park and one on Wabasha Street
at the south end of the Wabasha Street Bridge. A variance is requested from 11:30
a.m. to 10:30 p.m. on August 14, 15 & 16, 1998.
Also attached is a copy of the Public Hearing Noiice sent to properry owners within 200

Attached is a sound level variance application from Ron Maddox, General Manager,
RiverFeast to allow two sound stages, one at Kellogg Park and one on Wabasha Street
at the south end of the Wabasha Street Bridge. A variance is requested from 11:30
a.m. to 10:30 p.m. on August 14, 15 & 16, 1998.
Also attached is a copy of the Public Hearing Noiice sent to properry owners within 200
feet of the south end of the Wabasha Street Bridge and within 200 feet of Kellogg Park.
