2 WHEREAS, Public Health has requested the City Council to hold public hearings to consider
3 the advisability and necessity of ordering the repair or wrecking and removal of a one-story, wood
4 frame structure with a detached, one-stall, wood frame garage located on property hereinafter
5 referred to as the "Subject Property" and commonly known as 844 Galtier Street. This property is
6 legally described as follows, to wit:

11 WHEREAS, based upon the records in the Ramsey County Recorder's Office and
12 information obtained by Public Health on or before September 29, 1997, the following are the now
13 lrnown interested or responsible parties for the Subject Properiy: H.U.D. Properiy Disposition, 220
14 Second Street South, Minneapolis, MN 55401, Attn: Sophie Hallauer; Pham Express, Inc., 401

17 WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the
18 Saint Paul I.egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated
19 October 16, 1997; and

21 WHEREAS, this order informed the then known interested or responsible parties that the
22 structure located on the Subject Properry is a nuisance building(s) pursuant to Chapter 45; and
23
24 WHEREAS, this order informed the interested or responsible parties that they must repair ar
25 demolish the structure located on the Subject Property by November 17, 1997; and
26
27 WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring
28 this building(s) to constitute a nuisance condition; subject to demolition; and
29
30 WHEREAS, this nuisance condition has not been corrected and Public Health requested that
31 the City Clerk schedule public hearings befare the Legislative Hearing Officer of the City Council
32 and the Saint Paul City Council; and

34 WHEREAS, the interested and responsible parties have been served notice in accordance
35 with the provisions of Chapter 45 of the Saint Paul Legislauve Code, of the tune, date, place and
36 purpose of the public hearings; and

WHEREAS, a hearing was held before the Legislative Hearing Officer of the Saint Paul City
Council on Tuesday, January 20, 1998 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating tbis structure in
accordance with all applicable codes and ordinances, or in the alternauve by demolishing and
removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WfiEREAS, a hearing was held before the Saint Paul City Council on Wednesday, January
28, 1998 and the testimony and evidence including the action taken by the I.egislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public heazings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 844 Galtier Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
tYiree thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been coutinely monitored by the VacantlNuisance Buiidings
Code Enforcement Program.
8. That the l�own interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accardance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove ttris structure, fill the site and charge the costs incurred against the
Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul L,egislarive Code.
3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.

Saint Paul Public Health has declazed this building(s) to constitute a"nuisance" as defined by
Legislative Code, Chapter 45. Public Health has issued an order to the then known
responsible parties to eliminate this nuisance condition by correcting the deficiencies or by
razing and removing this building(s),
Inasmuch as this Order to Abate has not been complied with the nuisance condition remains
unabated, the communiry continues to suffer the blighting influence of this property. It is the
recommendation of Public Health that the Ciry Council pass a resolution ordering the
responsible parties to either repair, or demolish and remove this building in a timely m�er,
and failing that, authorize Public Health to proceed to demolition and removal, and to assess

condition that a$2,000 bond is posted by noon of January 28, 1998.

Gerry Strathman, Legislative Hearing Officer, called the meeting to order at 10:01 a.m.

Chuck Votel reported that he had spoken to the owner James Lorenz who said that he intended to
rehabilitate the property. The Council had previously approved a layover. The owner had to
post a bond and pay the fees, neither of which have been done.
James Lorenz appeazed and stated he hopes to close on the property tomorrow. The indoor
rehabilitation will be done in ten weeks. The gazage and exterior will begin when weather
permits.
Gerry Strathxnan asked James Lorenz was he prepared to post a bond. Mr. Lorenz responded that
he would. �
Gerry Strathman recommended 6 months to complete the rehabilitarion on condition that a
$2,000 bond is posted by noon of January 28, 1998.
734 Lafond Avenue (rear�
Chuck Votel reported that only the reaz house is the issue here. It was condemned in April of
1996. There have been three summary abatement notices. Vacant building fees and 1997 real
estate taxes are unpaid. The estimated cost to repair is $3,000. The cost to demolish is $5,330.
Randy Radunz, owner, appeazed and stated he has owned the properry for approximately 3
months. The house is structurally obsolete and should be torn down. He would like to salvage
as much as possible and demolish the house himself. Mr. Radunz asked for 90 days to tear the
house down. Chuck Votel stated it is permissible for the owner to do that with the proper
pemuts, but suggested vacant building fees be paid.
Gerry Strathman asked was the building secure. Mr. Radunz stated it would be difficult to get
into the building.
Gerry Strathman recommended amending the order to 3 months to remove or repair the building
if the vacant building fee is paid by noon of January 28, 1998.

Chuck Votel reported the bailding has been vacant since 7uly of 1996. The current property
owner is Michael DeGidio who called Mr. Votel this moming and said all the work is done and
is ready for a code compliance re-inspection. However, records show no permits have been
taken out yet for the electrical work. Mr. DeGidio stated he hired an electrical company to do the
work. If the work is done, it may be substandard. Also, a bond has not been posted. The code
compliance report is not ea�tensive; the owner does not have much work to do. Real estate taxes
and vacant building fees aze unpaid.
Beth Randall, 1558 W. Minnehaha, appeared and stated the building has not been occupied. The
ongoing concern is that there should not be long term vacant buildings in this neighborhood
because this can lead to nuisance conditions. The owner owes $3,400 on his mortgage and
foreclosure process is about to be started.
Gerry Strathman recommended approval of the 15 day order to remove or repair the building

No one appeared.
Chuck Votel reported Housing and Urban Development (HUD) obtained the building in
September of 1997. There have been four summary abatement no6ces. The Code Enforcement
lnspectors estimate the cost to repair this structure if $35,000. HUD has not conveyed their
intentions.
Gerry Strathman recommended approval of the 15 day order to remove or repair the building.

Chuck Votel reported that he had spoken to the owner James Lorenz who said that he intended to
rehabilitate the property. The Council had previously approved a layover. The owner had to
post a bond and pay the fees, neither of which have been done.
James Lorenz appeazed and stated he hopes to close on the property tomorrow. The indoor
rehabilitation will be done in ten weeks. The gazage and exterior will begin when weather
permits.
Gerry Strathxnan asked James Lorenz was he prepared to post a bond. Mr. Lorenz responded that
he would. �

Chuck Votel reported that only the reaz house is the issue here. It was condemned in April of
1996. There have been three summary abatement notices. Vacant building fees and 1997 real
estate taxes are unpaid. The estimated cost to repair is $3,000. The cost to demolish is $5,330.
Randy Radunz, owner, appeazed and stated he has owned the properry for approximately 3
months. The house is structurally obsolete and should be torn down. He would like to salvage
as much as possible and demolish the house himself. Mr. Radunz asked for 90 days to tear the
house down. Chuck Votel stated it is permissible for the owner to do that with the proper
pemuts, but suggested vacant building fees be paid.
Gerry Strathman asked was the building secure. Mr. Radunz stated it would be difficult to get
into the building.
Gerry Strathman recommended amending the order to 3 months to remove or repair the building
if the vacant building fee is paid by noon of January 28, 1998.

Chuck Votel reported the bailding has been vacant since 7uly of 1996. The current property
owner is Michael DeGidio who called Mr. Votel this moming and said all the work is done and
is ready for a code compliance re-inspection. However, records show no permits have been
taken out yet for the electrical work. Mr. DeGidio stated he hired an electrical company to do the
work. If the work is done, it may be substandard. Also, a bond has not been posted. The code
compliance report is not ea�tensive; the owner does not have much work to do. Real estate taxes
and vacant building fees aze unpaid.
Beth Randall, 1558 W. Minnehaha, appeared and stated the building has not been occupied. The
ongoing concern is that there should not be long term vacant buildings in this neighborhood
because this can lead to nuisance conditions. The owner owes $3,400 on his mortgage and
foreclosure process is about to be started.
Gerry Strathman recommended approval of the 15 day order to remove or repair the building

Chuck Votel reported Housing and Urban Development (HUD) obtained the building in
September of 1997. There have been four summary abatement no6ces. The Code Enforcement
lnspectors estimate the cost to repair this structure if $35,000. HUD has not conveyed their
intentions.

Council on Tuesday, January 20, 1998 to hear testimony and evidence, and after receiving testimony
and evidence, made the recommendation to approve the request to order the interested or responsible
parties to make the Subject Property safe and not detrimental to the public peace, health, safety and
welfare and remove its blighting influence on the community by rehabilitating tbis structure in
accordance with all applicable codes and ordinances, or in the alternauve by demolishing and
removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition of the structure to be completed within fifteen (15) days after the date of the Council
Hearing; and
WfiEREAS, a hearing was held before the Saint Paul City Council on Wednesday, January
28, 1998 and the testimony and evidence including the action taken by the I.egislative Hearing
Officer was considered by the Council; now therefore
BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public heazings, the Saint Paul City Council hereby adopts the following Findings and
Order concerning the Subject Property at 844 Galtier Street:
1. That the Subject Property comprises a nuisance condition as defined in Saint Paul
Legislative Code, Chapter 45.
2. That the costs of demolition and removal of this building(s) is estimated to exceed
tYiree thousand dollars ($3,000.00).
3. That there now exists and has existed multiple Housing or Building code violations at
the Subject Property.
4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible
parties to correct the deficiencies or to demolish and remove the building(s).
5. That the deficiencies causing this nuisance condition have not been corrected.
6. That Public Health has posted a placard on the Subject Property which declares it to
be a nuisance condition subject to demolition.
7. That this building has been coutinely monitored by the VacantlNuisance Buiidings
Code Enforcement Program.
8. That the l�own interested parties and owners are as previously stated in this
resolution and that the notification requirements of Chapter 45 have been fulfilled.
ORDER
The Saint Paul City Council hereby makes the following order:
1. The above referenced interested or responsible parties shall make the Subject Property safe
and not detrimental to the public peace, health, safety and welfare and remove its blighting
influence on the community by rehabilitating this structure and correcting all deficiencies as
prescribed in the above referenced Order to Abate Nuisance Building(s) in accardance with
all applicable codes and ordinances, or in the alternative by demolishing and removing the
structure in accordance with all applicable codes and ordinances. The rehabilitation or
demolition and removal of the structure must be completed within fifteen (15) days after the
date of the Council Hearing.

2. If the above corrective action is not completed within this period of time the Public Health,
Code Enforcement Program is hereby authorized to take whatever steps are necessary to
demolish and remove ttris structure, fill the site and charge the costs incurred against the
Subject Properry pursuant to the provisions of Chapter 45 of the Saint Paul L,egislarive Code.
3. In the event the building is to be demolished and removed by the Ciry of Saint Paul, all
personal properry or fixtures of any kind which interfere with the demolition and removal
shall be removed from the property by the responsible parties by the end of this time period.
If all personal properry is not removed, it shall be considered to be abandoned and the City
of Saint Paul shall remove and dispose of such property as provided by law.
4. It is further ordered, that a copy of this resolution be mailed to the owners and interested
parties in accordance with Chapter 45 of the Saint Paul L,egislative Code.
