DeGidio, 1419 Benson 12 Blvd. East, Sullwater, MN 55082-5996; First Bank of South Dakota, 1010 South Seventh Street, 13 Minneapolis, MN 55415-1749 14 15 WHEREAS, Public Health has served in accordance with the provisions of Chapter 45 of the 16 Saint Paul L.egislative Code an order identified as an "Order to Abate Nuisance Building(s)" dated 17 October 16, 1997; and 18 19 WHEREAS, this order informed the then known interested or responsible parties that the 20 structure located on the Subject Property is a nuisance building(s) pursuant to Chapter 45; and 21 22 WHEREA5, this order informed the interested or responsible parties that they must repair or 23 demolish the structure located on the Subject Properry by November 17, 1997; and 24 25 WHEREAS, the enforcement officer has posted a placard on the Subject Property declaring 26 this building(s) to constitute a nuisance condition; subject to demolition; and 27 28 WHBREA5, this nuisance condition has not been corrected and Public Health requested that 29 the City Clerk schedule public hearings before the Legislative Hearing Of�cer of the City Council 30 and the Saint Paul City Council; and 31 32 WHEREAS, the interested and responsible parties have been served noUce in accardance 33 with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and 34 purpose of the public hearings; and 35 36 WHEREAS, a hearing was held before the I.egislative Hearing Of6cer of the Saint Paui City 37 Council on Tuesday, January 20, 1998 to hear testimony and evidence, and after receiving testimony 38 and evidence, made the recommendation to approve the request to order the interested or responsible 39 parties to make the Subject Property safe and not detrimental to the public peace, health, safety and 40 welfare and remove its blighting influence on the community by rehabilitaUng this structure in 41 accardance with all applicable codes and ordinances, or in the alternative by demolishing and 42 removing the structure in accordance with all applicable codes and ordinances. The rehabilitation or 43 demolition of the structure to be completed within fifteen (15) days after the date of the Council 44 Hearing; and ORIGINAL 9� ��° WI�EREAS, a hearing was held before the Saint Paul City Council on Wednesday, 7anuary 28, 1998 and the testimony and evidence including the action taken by the L,egislative Hearing Officer was considered by the Council; now therefore BE IT RESOLVED, that based upon the testimony and evidence presented at the above referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order concerning the Subject Property at 1478 Edmund Avenue: 1. That the Subject Property comprises a nuisance condition as defined in Saint Paul Legislative Code, Chapter 45. 2. That the costs of demolition and removal of this building(s) is estimated to exceed three thousand dollars ($3,000.00). 3. That there now exists and has existed multiple Housing or Building code violations at the Subject Properry. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies or to demolish and remove the building(s). 5. That the deficiencies causing this nuisance condition have not been corrected. 6. That Public Health has posted a placard on the Subject Properry which declares it to be a nuisance condition subject to demolition. 7. That this building has been routinely monitored by the VacanUNuisance Buildings Code Enforcement Program. 8. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fulfilled. ORDER The Saint Paul City Council hereby makes the following order: 1. The above referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, health, safery and welfare and remove its blighting influence on the community by rehabilitating this structure and correcting all deficiencies as prescribed in the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable codes and ordinances, or in the alternative by demolishing and removing the structure in accordance with all applicable codes and ordinances. In the event the building is to be demolished and removed by the City of Saint Paul, all personal propeny or fixtures of any kind which interfere with the demolition and removal shall be removed from the properiy by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of Saint Paul shall remove and dispose of such properry as provided by law. 4. The Legislative Hearing Officer recommends approval of the 15 day order to remove ar repair the building. °I� -�o MINUTES OF LEGISLATIVE HEARING January 20, 1998 Room 330, City Hall Gerry Strathman, Legislative Hearing Officer STAFF PRESENT: Chuck Votei, Public Heaith Gerry Strathman, Legislative Hearing Officer, cailed the meeting to order at 10:01 a.m. 237 Page Street East Chuck Votel reported that he had spoken to the owner James Lorenz who said that he intended to rehabilitate the property. The Council had previously approved a layover. The owner had to post a bond and pay the fees, neither of which have been done. James Lorenz appeared and stated he hopes to close on the property tomorrow. The indoor rehabilitation will be done in ten weeks. The garage and exterior will begin when weather permits. Gerry Strathman asked James Lorenz was he prepazed to post a bond Mr. Lorenz responded that he wouid. Gerry Strathman recommended 6 months to complete the rehabilitafion on condi6on that a $2,000 bond is posted by noon of January 28, 1998. 734 Lafond Avenue (rear� Chuck Votel reported that only the reaz house is the issue here. It was condemned in April of 1996. There have been three sununary abatement notices. Vacant building fees and 1997 real estate taYes are unpaid. The estunated cost to repair is $3,000. The cost to demolish is $5,330. Randy Radunz, owner, appeared and stated he has owned the property for approximately 3 months. The house is structurally obsolete and should be torn down. He would like to salvage as much as possible and demolish the house himsel£ Mr. Radunz asked for 90 days to teaz the house down. Chuck Votel stated it is permissible for the owner to do that with the proper pernuts, but suggested vacant building fees be paid. Gerry Strathman asked was the building secwe. Mr. Radunz stated it would be difficult to get into the building. Gerry Strathman recommended amending the order to 3 months to remove or repair the building if the vacant building fee is paid by noon of January 28, 1998. q�-�� Minutes of 1/20/98 Legislative Hearing 1478 Edmund Avenue Page 2 Chuck Votel reported fhe building has been vacant since July of 1996. The current properry owner is Michael DeGidio who called Mr. Votel this morning and said all the work is done and is ready for a code compliance re-inspection. However, records show no permits have been taken out yet for the electdcai work. Mr. DeGidio stated he hired an electrical company to do the work. If the work is done, it may be substandard. Also, a bond has not been posted. The code compiiance report is not extensive; the owner does not have much work to do. Real estate taxes and vacant building fees aze unpaid. Beth Randall, 1558 W. Minnehaha, appeared and stated the building has not been occupied. The ongoing concern is that there shouid not be long term vacant buildings in this neighborhood because this can lead to nuisance conditions. The owner owes $3,400 on his mortgage and foreclosure process is about to be started. Gerry Sh�athman recommended approval of the 15 day order to remove or repair the building 844 Galtier Street No one appeazed. Chuck Votei reported Housing and Urban Development (H[ID) obtained the building in September of 1997. There have been four swnmary abatement notices. The Code Enforcement Inspectors estimate the cost to repair this structure if $35,000. HUD has not conveyed their intentions. Gerry Strathman recommended approval of the 15 day order to remove or repair the building. The Council had previously approved a layover. The owner had to post a bond and pay the fees, neither of which have been done. James Lorenz appeared and stated he hopes to close on the property tomorrow. The indoor rehabilitation will be done in ten weeks. The garage and exterior will begin when weather permits. Gerry Strathman asked James Lorenz was he prepazed to post a bond Mr. Lorenz responded that he wouid. The cost to demolish is $5,330. Randy Radunz, owner, appeared and stated he has owned the property for approximately 3 months. The house is structurally obsolete and should be torn down. He would like to salvage as much as possible and demolish the house himsel£ Mr. Radunz asked for 90 days to teaz the house down. Chuck Votel stated it is permissible for the owner to do that with the proper pernuts, but suggested vacant building fees be paid. Gerry Strathman asked was the building secwe. Mr. Radunz stated it would be difficult to get into the building. Also, a bond has not been posted. The code compiiance report is not extensive; the owner does not have much work to do. Real estate taxes and vacant building fees aze unpaid. Beth Randall, 1558 W. Minnehaha, appeared and stated the building has not been occupied. The ongoing concern is that there shouid not be long term vacant buildings in this neighborhood because this can lead to nuisance conditions. The owner owes $3,400 on his mortgage and foreclosure process is about to be started. Chuck Votei reported Housing and Urban Development (H[ID) obtained the building in September of 1997. There have been four swnmary abatement notices. The Code Enforcement Inspectors estimate the cost to repair this structure if $35,000. HUD has not conveyed their intentions.
