At the same time, public works employee 7ames M. Fitzpatrick was operating a snow plow west on Maryland, approaching the same intersection. According to witnesses, Fitzpatrick went through a red light striking Friberg's car with the blade of his plow. Plaintiffwas transported to the emergency room where she was treated for a lacerarion on her head and three fractured ribs. She was discharged after two ays an soon thereafter began trearing with a chiropractor, complaining of pain in her neck and back. In March of 1997, Plaintiff's doctor issued a report stating that she had "ongoing residuals associated with the injuries she sustained" in the accident. He stated t�iat she had reached maximum medical improvement and that her present complaints are permanent. He reported that her permanent injuries limited her daily do some ofthe things she could do pre-accident (cleaning, dusting, etc.). Finally, he reported that she would need 12 to 18 treatments per year to maintain her present status and that she would be prone to re-injury and degeneration. The parties engaged in court-ordered mediation on 7uly 8, 1998. On that date the parties agreed to a proposed settlement of Friberg's claims for a total payment of $12,000.00 by the City of St. Paul.
