1 BE IT RESOLVED, that, upon the petition of the Salvation Army, as documented in Finance
2 Department File Number 6-1998, public properties hereinafter described aze hereby vacated and
3 discontinued as public property.
4 The property to be vacated is described as follows:

7 This vacation shall be subject to the terms and condition of Chapter 130, codified Mazch 1, 1981, of the

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereof and shall be
subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written pernussion from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

of Northern States Power Company.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of U.S. West Communication, Inc.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Continental CabieVision, Saint Paul, Inc.
That plans for the use of the vacated area shall be subject to site review by the Office of License,
Inspection and Environmental Protection.
30 8. That the petitioner shall pay all costs and expenses of reconstrucung the Forbes/Smith and
31 Forbes/W. Seventh intersections, including but not limited to, new curbs, sidewalks, boulevards,
32 storm drains and street sign removal, which may be necessary to properly eliminate the
33 appeazance of a public thoroughfare. Such reconsiruction shall be consistent with requirements
34 of the Department of Public W orks.
35 9. That, concurrently with the reconstruction of curbing and at its own cost and expense, the
36 petitioner shall install new lighting conduit on the east side of Smith Avenue. Such installation
37 shall be consistent with requirements of the Department of Public Works.
38 10. That the petitioner shall bear a11 costs and expenses associated wath the abandonment of the two
39 poles feeding City street lights in the vacated azea.

1 11. The petitioner shall be responsible for the costs and expenses of rerouting the existing catch
2 basin on West Seventh Street just south of the vacated area, as well as any street grade changes
3 that may be necessary to properly drain the intersections of Forbes at West Seventh. Such
4 reconstruction shall be consistent with requirements of the Department of Public Works Sewers
5 Division.
6 12. That the petitioner agrees to landscape and maintain the sueet to be vacated and its properry lying
7 southerly thereof, easterly of Smith Avenue and northwesterly of West Seventh Street to conform
8 to the site plan approved by the Office of License, Inspection and Environmental Protection.
9 13. T'hat the two existing catch basins within the vacated area of Forbes shall become the
10 responsibility of the petitioner.
11 14. That the petitioners, their successors and assigns agree to indemnify, defend and save hannless
12 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
13 brought as a result of injuries or damages received or sustained by any person, persons or
14 property on account of this vacation or petitioners' use of this property, including but not limited
15 to a claim brought because of any act of omission, neglect or misconduct of said petitioner or
16 because of any claims or liability arising from any violation of any law or regulation made in
17 accordance with the law, whether by the petitioner or any of their agents or employees
18 15. That the petitioners, their successors and assigns shall, within 60 days of the effective date of this
19 resolution, file with the City Clerk an acceptance in writing of the conditions of this resolution,
20 and shall, within the period(s) specified in the terms and conditions of this resolution, comply in
21 all respects with these terms and conditions.

Subject: Forbes Avenue Vacation - Effect on Parking
During the hearing on July 22nd, to consider the vacation of that part of Forbes Avenue
lying easterly of Smith Avenue and northwesterly of West Seventh Street, the Council
requested a report on the effect of the vacation on the parking available for the property
located at 203 Forbes Avenue. Attached you will find a report, marked Attachment A",
prepared by Tom Beach of the Office of License, Inspection and Environmental
Protection and Bill Hagland of Public Works.
The report indicates that, if the vacation is approved, the owner could develop three
private parking spaces in the vacated area that would accrue to the property at 203 Forbes
Avenue To facilitate access to these private parking spaces, I recommend the following
condition be appended to the vacation resolution:
That the petitioner convey to the owner of the property located at 203 Forbes
Avenue a permanent access easement, running with the land, over and across the
northerly 20.00 feet of the southerly one half of the area to be vacated.
A second point of contention was the loss of street frontage available to the property at
203 Forbes Avenue. As shown on the enclosed Attachment "B", prior to the vacation, the
said 203 Forbes Avenue had no frontage on West Seventh and approximately 72.5 feet of
frontage on Forbes. Following the vacation, the properiy would lose its frontage on
Forbes but would gain about 38 feet of frontage on West Seventh.

RE: Parking on Forbes Avenue
The owner of property at 203 Forbes Avenue has raised concerns about how the proposed vacation of
Forbes would affect on-street parking for his property. The purpose of this memo and the attached plan
is to compare how much parking is available now with how much would be available if Forbes is vacated
and the western portion is developed as a parkina Lot by the Salvation Amiy.
Current parking
Counting both sides of the street, there are currently approximately 12 on-street parking spaces on Forbes
Avenue between Smith and West 7th Street. Three of these spaces are located in front of the property at
203 Forbes Avenue. Since these spaces are on a public street, they are available to anyone who wants to
park there.
Parking if Forbes is vacated
If Forbes is vacated, the Salvation Army would build a parking lot with 19 parking spaces on their
portion of the vacated right of way. Tn addition, the properry at 203 Forbes Avenue could provide three
parking spaces in front of his property. These spaces would be private and the property owners could
designate these spaces for their own use.
In addition, there is the potential to provide one new on-street parking space on West Seventh Street if
the existing curb is extended. This space would be available to anyone who wants to park there.

Vacation of Forbes Avenue, between
Smith Avenue. and W. Seventh Street
The Department of Public Works has no objections to this vacation subject to
the following:
1) Plans for the use of vacated Forbes Avenue shall be submitted to
LIEP and subject to their Site Plan approval process.
2) The petitioner shall pay all costs and expenses for any reconstruction of the
Forbes/Smith and Forbes/W. Seventh intersections which may be necessary to
properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street
sign removal, all to the satisfaction of the Department of Public Works.
3) The petitioner shall be responsible for the relocation of the catch basins and
manhole at Forbes and West Seventh Street to the satisfaction of the
Department of Public Works, Sewer Engineering. Street grade changes may
be necessary to properly drain the intersections of Forbes at West Seventh,
and Forbes at Smith.
4) The two existing catch basins within the vacated area of Forbes would
become the responsibility of the property owners. See attached sewer records.
5) The City of Saint Paul, Department of Public Works will need to retain a
permanent 20 foot subterranean easement between the elevations of 50.0 and
60.0 City datum, centered on the center line of the existing sanitary sewer main.

6) There are two poles that feed City street lights which the petitioners shall
be responsible for abandoning. The petitioners shall also install new lighting
conduit on the east side of Smith Avenue when new curbing is installed.

The Water Utility has a 6-inch water main in that part of Forbes Avenue proposed for vacation. To
provide for continued access to our facility, the Water Utility requires an easement be retained over
that part of Forbes Avenue lying easterly of the east right-of-way line of Smith Avenue and
northwesterly of the northwest right-of-way line of West Seventh Street.
Restrictions within the area are as follows:
No buildings, shuctures or trees are permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water Ufility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Water Utility opexations, all removal, replacement or
modification costs shall be borne solely by the petitioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Boazd of Water Commissioners, its officers, agents, employees
and servants from all suits, actions or claims which shall arise from any injuries or
damages received ar sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action

Yesterday, Linda Dickhut sent me a site plan that shows that Patrick Carlone's property will now
have W. Seventh frontage if the street vacation goes through as proposed. Based on her drawing,
I withdraw the objecUOn that I put in PED's notes to you on the vacation request. The plan looks
pretty good. The little plaza on the triangle is a nice touch. Hope it wili be maintained well.

That the petitioner's, their successors and assigns shall pay $500.00 as an administrative fee for
this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereof and shall be
subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written pernussion from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

employees, agents or business invitees.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Northern States Power Company.
That a permanent utility easement shall be retained within the vacated area to protect the interest
of U.S. West Communication, Inc.
That a permanent utility easement shall be retained within the vacated azea to protect the interest
of Continental CabieVision, Saint Paul, Inc.
That plans for the use of the vacated area shall be subject to site review by the Office of License,
Inspection and Environmental Protection.
30 8. That the petitioner shall pay all costs and expenses of reconstrucung the Forbes/Smith and
31 Forbes/W. Seventh intersections, including but not limited to, new curbs, sidewalks, boulevards,
32 storm drains and street sign removal, which may be necessary to properly eliminate the
33 appeazance of a public thoroughfare. Such reconsiruction shall be consistent with requirements
34 of the Department of Public W orks.
35 9. That, concurrently with the reconstruction of curbing and at its own cost and expense, the
36 petitioner shall install new lighting conduit on the east side of Smith Avenue. Such installation
37 shall be consistent with requirements of the Department of Public Works.
38 10. That the petitioner shall bear a11 costs and expenses associated wath the abandonment of the two
39 poles feeding City street lights in the vacated azea.

1 11. The petitioner shall be responsible for the costs and expenses of rerouting the existing catch
2 basin on West Seventh Street just south of the vacated area, as well as any street grade changes
3 that may be necessary to properly drain the intersections of Forbes at West Seventh. Such
4 reconstruction shall be consistent with requirements of the Department of Public Works Sewers
5 Division.
6 12. That the petitioner agrees to landscape and maintain the sueet to be vacated and its properry lying
7 southerly thereof, easterly of Smith Avenue and northwesterly of West Seventh Street to conform
8 to the site plan approved by the Office of License, Inspection and Environmental Protection.
9 13. T'hat the two existing catch basins within the vacated area of Forbes shall become the
10 responsibility of the petitioner.
11 14. That the petitioners, their successors and assigns agree to indemnify, defend and save hannless
12 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
13 brought as a result of injuries or damages received or sustained by any person, persons or
14 property on account of this vacation or petitioners' use of this property, including but not limited
15 to a claim brought because of any act of omission, neglect or misconduct of said petitioner or
16 because of any claims or liability arising from any violation of any law or regulation made in
17 accordance with the law, whether by the petitioner or any of their agents or employees

Subject: Forbes Avenue Vacation - Effect on Parking
During the hearing on July 22nd, to consider the vacation of that part of Forbes Avenue
lying easterly of Smith Avenue and northwesterly of West Seventh Street, the Council
requested a report on the effect of the vacation on the parking available for the property
located at 203 Forbes Avenue. Attached you will find a report, marked Attachment A",
prepared by Tom Beach of the Office of License, Inspection and Environmental
Protection and Bill Hagland of Public Works.
The report indicates that, if the vacation is approved, the owner could develop three
private parking spaces in the vacated area that would accrue to the property at 203 Forbes
Avenue To facilitate access to these private parking spaces, I recommend the following
condition be appended to the vacation resolution:
That the petitioner convey to the owner of the property located at 203 Forbes
Avenue a permanent access easement, running with the land, over and across the
northerly 20.00 feet of the southerly one half of the area to be vacated.
A second point of contention was the loss of street frontage available to the property at
203 Forbes Avenue. As shown on the enclosed Attachment "B", prior to the vacation, the
said 203 Forbes Avenue had no frontage on West Seventh and approximately 72.5 feet of
frontage on Forbes. Following the vacation, the properiy would lose its frontage on
Forbes but would gain about 38 feet of frontage on West Seventh.

RE: Parking on Forbes Avenue
The owner of property at 203 Forbes Avenue has raised concerns about how the proposed vacation of
Forbes would affect on-street parking for his property. The purpose of this memo and the attached plan
is to compare how much parking is available now with how much would be available if Forbes is vacated
and the western portion is developed as a parkina Lot by the Salvation Amiy.
Current parking
Counting both sides of the street, there are currently approximately 12 on-street parking spaces on Forbes
Avenue between Smith and West 7th Street. Three of these spaces are located in front of the property at
203 Forbes Avenue. Since these spaces are on a public street, they are available to anyone who wants to
park there.
Parking if Forbes is vacated
If Forbes is vacated, the Salvation Army would build a parking lot with 19 parking spaces on their
portion of the vacated right of way. Tn addition, the properry at 203 Forbes Avenue could provide three
parking spaces in front of his property. These spaces would be private and the property owners could
designate these spaces for their own use.
In addition, there is the potential to provide one new on-street parking space on West Seventh Street if
the existing curb is extended. This space would be available to anyone who wants to park there.

Vacation of Forbes Avenue, between
Smith Avenue. and W. Seventh Street
The Department of Public Works has no objections to this vacation subject to
the following:
1) Plans for the use of vacated Forbes Avenue shall be submitted to
LIEP and subject to their Site Plan approval process.
2) The petitioner shall pay all costs and expenses for any reconstruction of the
Forbes/Smith and Forbes/W. Seventh intersections which may be necessary to
properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street
sign removal, all to the satisfaction of the Department of Public Works.
3) The petitioner shall be responsible for the relocation of the catch basins and
manhole at Forbes and West Seventh Street to the satisfaction of the
Department of Public Works, Sewer Engineering. Street grade changes may
be necessary to properly drain the intersections of Forbes at West Seventh,
and Forbes at Smith.
4) The two existing catch basins within the vacated area of Forbes would
become the responsibility of the property owners. See attached sewer records.
5) The City of Saint Paul, Department of Public Works will need to retain a
permanent 20 foot subterranean easement between the elevations of 50.0 and
60.0 City datum, centered on the center line of the existing sanitary sewer main.

6) There are two poles that feed City street lights which the petitioners shall
be responsible for abandoning. The petitioners shall also install new lighting
conduit on the east side of Smith Avenue when new curbing is installed.

The Water Utility has a 6-inch water main in that part of Forbes Avenue proposed for vacation. To
provide for continued access to our facility, the Water Utility requires an easement be retained over
that part of Forbes Avenue lying easterly of the east right-of-way line of Smith Avenue and
northwesterly of the northwest right-of-way line of West Seventh Street.
Restrictions within the area are as follows:
No buildings, shuctures or trees are permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water Ufility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Water Utility opexations, all removal, replacement or
modification costs shall be borne solely by the petitioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Boazd of Water Commissioners, its officers, agents, employees
and servants from all suits, actions or claims which shall arise from any injuries or
damages received ar sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or business invitee.

have W. Seventh frontage if the street vacation goes through as proposed. Based on her drawing,

this vacation which is due and payable within 60 days of the effective date of this resolution.
That a permanent utility easement shall be retained on, over, under and across the vacated azea on
behalf of the City of Saint Paul, Department of Public Works to reserve the right of the City to
maintain and operate any sewer in or upon said easement and to enter upon said easement or any
portion thereof at any time and from time to time, for the purposes of future construction,
reconstruction, inspecting, maintaining or repairing the same or any part thereof and shall be
subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or any
other objects that will prohibit normal access to utility facilities for maintenance purposes
will be permitted within the easement area.
b. Improvements in or upon the above described easement that do not prohibit the City from
exercising its reserved rights may be allowed by obtaining written pernussion from the
Department of Public Works Sewer Division with the understanding that the restoration
and costs of such improvements shall be the sole responsibility of the petitioner, its
successors and assigns in the event the City exercises its reserved easement rights.

suits, action or claims which shall arise from any injuries or damages received or
sustained by any break in any service pipe, water main, or connection in said reserved
easement, arising out of or resulting from any action or negligence of the petitioner, its

31 Forbes/W. Seventh intersections, including but not limited to, new curbs, sidewalks, boulevards,
32 storm drains and street sign removal, which may be necessary to properly eliminate the
33 appeazance of a public thoroughfare. Such reconsiruction shall be consistent with requirements

35 9. That, concurrently with the reconstruction of curbing and at its own cost and expense, the
36 petitioner shall install new lighting conduit on the east side of Smith Avenue. Such installation
37 shall be consistent with requirements of the Department of Public Works.

39 poles feeding City street lights in the vacated azea.

9 13. T'hat the two existing catch basins within the vacated area of Forbes shall become the
10 responsibility of the petitioner.
11 14. That the petitioners, their successors and assigns agree to indemnify, defend and save hannless
12 the City of Saint Paul, its officers and employees from all suits, actions or claims of any character
13 brought as a result of injuries or damages received or sustained by any person, persons or
14 property on account of this vacation or petitioners' use of this property, including but not limited

Subject: Forbes Avenue Vacation - Effect on Parking
During the hearing on July 22nd, to consider the vacation of that part of Forbes Avenue
lying easterly of Smith Avenue and northwesterly of West Seventh Street, the Council
requested a report on the effect of the vacation on the parking available for the property
located at 203 Forbes Avenue. Attached you will find a report, marked Attachment A",
prepared by Tom Beach of the Office of License, Inspection and Environmental
Protection and Bill Hagland of Public Works.
The report indicates that, if the vacation is approved, the owner could develop three
private parking spaces in the vacated area that would accrue to the property at 203 Forbes
Avenue To facilitate access to these private parking spaces, I recommend the following
condition be appended to the vacation resolution:
That the petitioner convey to the owner of the property located at 203 Forbes
Avenue a permanent access easement, running with the land, over and across the
northerly 20.00 feet of the southerly one half of the area to be vacated.
A second point of contention was the loss of street frontage available to the property at
203 Forbes Avenue. As shown on the enclosed Attachment "B", prior to the vacation, the
said 203 Forbes Avenue had no frontage on West Seventh and approximately 72.5 feet of
frontage on Forbes. Following the vacation, the properiy would lose its frontage on
Forbes but would gain about 38 feet of frontage on West Seventh.

RE: Parking on Forbes Avenue
The owner of property at 203 Forbes Avenue has raised concerns about how the proposed vacation of
Forbes would affect on-street parking for his property. The purpose of this memo and the attached plan
is to compare how much parking is available now with how much would be available if Forbes is vacated
and the western portion is developed as a parkina Lot by the Salvation Amiy.
Current parking
Counting both sides of the street, there are currently approximately 12 on-street parking spaces on Forbes
Avenue between Smith and West 7th Street. Three of these spaces are located in front of the property at
203 Forbes Avenue. Since these spaces are on a public street, they are available to anyone who wants to
park there.
Parking if Forbes is vacated
If Forbes is vacated, the Salvation Army would build a parking lot with 19 parking spaces on their
portion of the vacated right of way. Tn addition, the properry at 203 Forbes Avenue could provide three
parking spaces in front of his property. These spaces would be private and the property owners could
designate these spaces for their own use.
In addition, there is the potential to provide one new on-street parking space on West Seventh Street if
the existing curb is extended. This space would be available to anyone who wants to park there.

Vacation of Forbes Avenue, between
Smith Avenue. and W. Seventh Street
The Department of Public Works has no objections to this vacation subject to
the following:
1) Plans for the use of vacated Forbes Avenue shall be submitted to
LIEP and subject to their Site Plan approval process.
2) The petitioner shall pay all costs and expenses for any reconstruction of the
Forbes/Smith and Forbes/W. Seventh intersections which may be necessary to
properly eliminate the appearance of a public thoroughfare, including but not
limited to, costs for new curbs, sidewalks, boulevards, storm drains, and street
sign removal, all to the satisfaction of the Department of Public Works.
3) The petitioner shall be responsible for the relocation of the catch basins and
manhole at Forbes and West Seventh Street to the satisfaction of the
Department of Public Works, Sewer Engineering. Street grade changes may
be necessary to properly drain the intersections of Forbes at West Seventh,
and Forbes at Smith.
4) The two existing catch basins within the vacated area of Forbes would
become the responsibility of the property owners. See attached sewer records.
5) The City of Saint Paul, Department of Public Works will need to retain a
permanent 20 foot subterranean easement between the elevations of 50.0 and
60.0 City datum, centered on the center line of the existing sanitary sewer main.

6) There are two poles that feed City street lights which the petitioners shall
be responsible for abandoning. The petitioners shall also install new lighting
conduit on the east side of Smith Avenue when new curbing is installed.

The Water Utility has a 6-inch water main in that part of Forbes Avenue proposed for vacation. To
provide for continued access to our facility, the Water Utility requires an easement be retained over
that part of Forbes Avenue lying easterly of the east right-of-way line of Smith Avenue and
northwesterly of the northwest right-of-way line of West Seventh Street.
Restrictions within the area are as follows:
No buildings, shuctures or trees are permitted within the easement area, or any
temporary structure, material storage, fixture or other objects that may prohibit
normal access to water facilities for maintenance purposes without written
permission from the Water Ufility.
2. No change from the existing grade or change in surfacing within the easement
area is permitted without written permission from the Water Utility.
3. Should it be necessary that the petitioner's works or improvements be removed or
damaged as a result of Water Utility opexations, all removal, replacement or
modification costs shall be borne solely by the petitioner.
4. That the petitioner, its successors and assigns shall fully indemnify, defend and
save harmless the Boazd of Water Commissioners, its officers, agents, employees
and servants from all suits, actions or claims which shall arise from any injuries or
damages received ar sustained by any break in any service pipe, water main, or
connection in said reserved easement, arising out of or resulting from any action
or negligence of the petitioner, its employees, agents or business invitee.

Yesterday, Linda Dickhut sent me a site plan that shows that Patrick Carlone's property will now
have W. Seventh frontage if the street vacation goes through as proposed. Based on her drawing,
I withdraw the objecUOn that I put in PED's notes to you on the vacation request. The plan looks
pretty good. The little plaza on the triangle is a nice touch. Hope it wili be maintained well.
